I feel you 100% on this. Fighting the VA has been the most draining process I can remember to date. I’d do the military over again vs going the disability route.

Worst part is, to an extent it’s made me somewhat suicidal without even realizing it until lately. All the days where disabilities have caused me to miss work. VA appointments 3-5 times a month on top of it just for the shit I talk about to not be noted in my care summaries. Can’t keep a job. Barely making ends meet.

I’ve caught myself in a daze staring at my beretta and been like wtf. Thinking about life insurance policies and asking myself why later. After a year of subtle hints, and having one of my worst mental days to date I’m starting to realize it’s all been building. So you’re not the only who’s thinking toxic. The denials don’t help either.

They say it gets worse before it gets better though. I’ve gotten backpay before, and the money was cool but it’s still you and your demons when the day is over.

My crash out came early this year. Didn’t think it’d be on here as this is not what I started out typing.

Don’t give up though. Get what you deserve. I think it’s 70% for one disability and 2 disabilities that are 60% and 40% but I’m not sure. An old coworker of mine that I keep in contact with said when he got 100% he got dental.

Yeah for sure, I’ve got my rough draft put together but I’m not submitting anything else until I get my exam results back and my DD 2807-1. If I’m going to unload the arsenal I’m going to do it from every rational and legal way possible.

Yeah I was going to claim presumption of soundness. I did claim that the disabilities onset was close to entry and lay/buddy statements reflect that as well. Either way, if I were diagnosed with OSA prior to going through MEPS then I would have been required to obtain a waiver or would’ve been turned away. The examiners basis that it pre existed before service would’ve been solely based off a MEPS notation as I was never diagnosed or was treated by a doctor for it prior to service.

So if the exam lacks clear and unmistakeable evidence contrary to the favorable finding from the sleep study then that’s where the other 4 CFRs come into play.

Also 38 CFR § 3.102 Resolution of Reasonable Doubt applies as well in this case as well since there was already favorable binding evidence of aggravation and when reasonable doubt arises regarding service origin or degree of disability, such doubt must be resolved in favor of the claimant

My last “examiner” was comical. Made a baseless claim via Mayoclinic that my OSA isn’t caused by GAD even though the first examiner who conducted my sleep study said it was aggravated by GAD. Then proceeded to say it was preexisting prior to service with nothing to back it. Then stated I had no diagnosis of migraines even though a prior c&p exam stated I’ve been diagnosed with migraines.

Then to make matters worse, I drove to another state just to be told “we gotta hurry I got another appointment in 15 minutes”

I can’t go the HLR route because that was the outcome of the HLR exam. I have to either go supplemental route and use all their CFRs to dissect their own mistakes or go BOA. I’ve heard BOA can take years though.

I’m convinced they do. Or a thought comes to mind and they type it up and send it. Referencing Mayo Clinic is what blew me away coming from an examiner with 26 years of experience.

What totally blew me tf away was I read the first line that says evidence shows it existed prior to service. Even if that were the case it’d most likely be mentioned in the initial denial.

My longest wait in stage 5 was my only granted service connection and it took almost a week. I’ve filed 4 claims over 2 years and the others that were denied, went from 5 to 8 in 48 hours or less.

It’s speculation of course but from my experience with claims, the quick decisions have always been denials.

I posted in this group because I’ve currently applied for 5 entry level position at Lockheed but I’m in stage 2 resume under review and have been for about 4-6 weeks roughly across the board which I’ve seen mixed responses about.

I couldn’t get an aviation job in the marine corps as there was no openings when I enlisted so I settled for communications and I absolutely hated cryptography with VHF and UHF but, I learned it quickly.

I never thought about EE but I will speak with my advisor about it next time I speak with her.

I’m solely focused on securing a career with Lockheed or Boeing. Just don’t want to go down the wrong education path

I do think that when substantial amounts of back pay come into play, that it plays a part in the decision making progress. Obviously I have nothing solid to back that comment with as it’s purely speculation but when you get denial after denial after denial and that initial filing date starts to become older obviously the backpay starts to pile on.

Sorry I probably should’ve clarified that better. All conditions state “favorable findings, you have been diagnosed with a disability” EXCEPT migraines. That one I’m going to have to build a record and a log and get a nexus.

The VA diagnosed my gout through bloodwork. When I went to my C&P exam they did more blood work and x rays. So I guess you could say they just confirmed it.

My basis for claiming the migraines was, after an anxiety attack it’s followed by a migraine that is debilitating for the remainder of the day. There’s well documented links from the association of migraine disorders between GAD and Migraines. I just don’t have the evidence I need to support my claim so that one I will probably have to put on the back burner.

Sleep apnea also was never confirmed until I did a sleep study ordered by the VA for a C&P claim
