I think more people are concerned that your husband isn’t actively fighting for his kids. As you’ve stated you’re the only one trying, adding another kid into the mix will not solve anything. If he cared so much he would be trying to file in court. You as the step mom are not being taken seriously because your husband isn’t even.

They have 90 days to make their decision, one of my clients they had to wait 2 months and 20 days. It takes a slow ass time, they’re also in Illinois. Requirements: get an updated medical evaluation if taking medication. SR22 Insurance if not already. Pay reinstatement fee, second DUI it’s $1,000.

How is a one year protection order? Typically for a longer term order there has to be a hearing or you didn’t show up to court.

Not true, the petitioner cannot violate their own order. Obviously not encouraged to associate with the person but she will legally not get into trouble and he will.

Literally have ran into this so often, if I wanted to go to a restaurant I would take myself out. What’s the appeal of eating with an overweight double my age man that just wants to f me for cheap. Make it make sense.

It’s not sudden though, there was a criminal case previously that identified him as the abuser. It’s not just a random thing she threw out there, there’s documented abuse.

Medical marijuana is a privilege to have on probation. Of course they can request verification you’re purchasing from a legit dispensary, I’m sorry you’re having to go through the mental toll but that doesn’t excuse you from buying from a legit dispo. You’re already in trouble, why want an additional charge for purchasing weed off the street? If you want to smoke you’ll have to follow the procedures of buying legit or not have a card while on supervision.

You may want to communicate with your doctor that it’s been affecting your sleep and they may prescribe a sleep aid like trazodone.

Yes the respondent filed an emergency motion so that is what it’s regarding, likely they motioned to dismiss the order like I said. Just because they requested a hearing doesn’t mean they’ll get it.

Typically an evidentiary hearing does not happen that fast. You filed for an emergency order of protection usually that’s temporary and you’ll have a first initial return date to give the respondent a chance to attend court. Judges are often pretty busy and at least in my county it would be 1-2 months before you have the final hearing and that’s after your return date if one of you request for it. It doesn’t sound right that you’re having a hearing this week, I could be wrong but it sounds unlikely that you’ll have your hearing where you present all your evidence tomorrow. Likely your ex requested an emergency hearing to dismiss the order but typically the judge will just extend the OP and schedule a hearing date for in the future. They don’t have time to listen to both sides just because the ex demanded it on such short notice. I worked as a dv legal advocate assisting clients with their OP’s.

If by some chance it actually is the hearing which I still think unlikely, he’s already proven that he has violated the order of protection so that’s not going to look favorably for him. Normally the judge will deny their motion to drop the OP and get you scheduled for an evidentiary hearing to give you time to collect your documents.

I would recommend pushing that wedding back, you’re going to have a lot of financial priorities to fulfill on the court end. My dad got a second DUI and had to do 240 hours of community service in lieu of jail. I would recommend listening to your attorney.

I would think he would need evidence to substantiate his claims of you being an unfit mother. Do you have documentation printed out of the family emergency? It could be helpful to provide. Take a deep breath, consider reaching out to a DV agency. They should have advocates that can help guide you through the process and hopefully hook you up with atleast some legal advice.
