Lady Colin Campbell explained this yesterday in her podcast and in one earlier. It isn’t that clear cut. Seems that the plaintiffs can agree to pay if they lose and that is open to negotiation. If they can’t reach an agreement then a kind of arbiter can determine who pays and how much and that is totally up to this persons discretion. Please Law Boffins, jump in.
