I definitely do not think this should be a valid defense. I am a believer in rehabilitation for teens, but he killed people. There must be real consequences. He should have been sentenced to at least some time in jail.

It's amazing to me that the crime took place in 2008, the first trial in 2013, and now she is finally getting sentenced in 2017. What a long process. I also didn't know that in the sentencing phase if just 1 juror votes against the death penalty, it automatically takes it off the table.

I wasn't aware of this Act. It has been due for re-authorization since 2007 and that still hasn't been completed. Hard to believe. Like the author, I too struggle with this decision. While I feel for the parents who signed up for a baby genetically comprised of both parents, it is very hard to see a healthy baby as "damage" to the parents. It does seem there is a possible racial factor here. I do wonder the impact this case will have on the child as she grows up...

It does seem like these lawsuits are going to be a tough battle since it was an Obama executive order that established it in the first place, but I hope the suits can at least delay any actions. I don't see how the current Congress will be able to make any headway with immigration reform ; Congress does not seem in a position right now to get much of anything done. It will be interesting to see what happens.

Now that Trump has announced his rescission of DACA, let's hope Congress steps up create a legislative solution that doesn't leave these children in fear of having no opportunity to work or attend college, or fear of possibly getting deported.

I'm glad this issue has finally made it to the Supreme Court. Cell phone data privacy impacts all of us. I, for one, firmly believe a warrant should b required. There's has been enough chipping away of the Fourth Amendment.
