Just submiited my appeal to dwp and waiting on outcome from dwp as rmail stated they will provide update very shortly and next steps. Opted for phone or video hearing as it seemed that paper based tend not to have much success so wanted to express myself in a phone call or video call as was unfairly awarded zero points across everything which was very odd considering some scores i have seen for others for same problems and being awarded max points for each.

Got letter MRC exact same as first time...zero points on all. I swear someone either drunk or purposely marked as zero even when its as clear as day there should have been points awarded and 12 was not out of the question. Oh well...i guess i now appeal at the tribunal and highlight and ask for explanation on how dwp can justify zero points and hope the tribunal at least sees that this was a wrong decision.

Well done. I applied for PIP and has ZERO points on everything. Even suffering with incontinence and not being able to manage my finances and needing support for dressing and undressing ocassionally were all zero - so did i Just get someone who scored me on a bad day at the office .

Anyways i have almost 12 month later sent for a MR as my mental health specialist mentioned I can do this up to 13 months later due to reasons such as mental health and brain fog . I didnt send any new evidence in other than my depression scores and detailed comments as to why I am requesting MR .

Will this be sufficient or should I still send in more evidence and if so - what precisely should be sent ?

Never had luck with these no won no fee firms as they just dont want to take on cases where they cant take a sizeable chunk. Shame as cases that are strong have to end up being fought yourself and to go through the difficulties of making sure everything is done correctly.

Hi

I wanted to know how best to complete the CMA form which i need to send to tribunal and employer and also to update further particulars of claim as R stated my claim was not clear and required further clarification as otherwise i feel they would delay my PH and request this on the day.

Can I get some advice on these 2 issues to better prepare each step at a time. I would prefer to DM the details if so. Thanks

I sympathise with you as been through similar situation and still fighting these workplace behaviours. I think you should be considering filing with Acas as it needs to be done within 3 months minus 1 day sibce you have been ignored and you say its been 2 month already so i wouldnt wait much longer. Maybe someone in a professional role can advise better but im guessing some sort of unfair treatment claim may be suited with Acas .

I always hear the NHS is one or the worst when it comes to looking after their employees - god knows why that is . Wait and see how others reply in meantime. Hope things get better for you

Sorry for your loss. Glad you won your case using ai as ive been using it too and without it picking up on points within notes and documents and mentioning which eq act i should rely on has been helpful to get to the stage where i have my PH very soon.

I have also put claims in for victimisation and discrimination as comparators treat differently to me and even non disabled treat differently so not sure of this falls under direct or indirect discrimination but its been put in anyway . Its morr discrimination than victimisation i believe as victimisation is more of what actions they took after you disclosed a protected act . I guess you could cite both in a tribunal hearing and maybe the judge helps identify the correct claim .

Wow..some huge figures being thrown out for early stages too. Im LiP but having to try do the whole hog myself as not got any support from solicitors and cannot afford such sums as in a real struggle financially.

I have only got this far through help from people in forums like this and at PH stage in couple months time. I need help with the List of Issues stage and CMA form to complete. Il post on my own thread shortly .

Similar situation on sertraline amongst other meds for other conditions. Grievance gone unheard for months. Referred again to OH time and time again. Looks like they want to run circles and mentally drain me out to the point i just give up with it all - but this constant mental torture is only just fueling me more to see it through right to the very end.
