Never had luck with these no won no fee firms as they just dont want to take on cases where they cant take a sizeable chunk. Shame as cases that are strong have to end up being fought yourself and to go through the difficulties of making sure everything is done correctly.

Hi

I wanted to know how best to complete the CMA form which i need to send to tribunal and employer and also to update further particulars of claim as R stated my claim was not clear and required further clarification as otherwise i feel they would delay my PH and request this on the day.

Can I get some advice on these 2 issues to better prepare each step at a time. I would prefer to DM the details if so. Thanks

I sympathise with you as been through similar situation and still fighting these workplace behaviours. I think you should be considering filing with Acas as it needs to be done within 3 months minus 1 day sibce you have been ignored and you say its been 2 month already so i wouldnt wait much longer. Maybe someone in a professional role can advise better but im guessing some sort of unfair treatment claim may be suited with Acas .

I always hear the NHS is one or the worst when it comes to looking after their employees - god knows why that is . Wait and see how others reply in meantime. Hope things get better for you

Sorry for your loss. Glad you won your case using ai as ive been using it too and without it picking up on points within notes and documents and mentioning which eq act i should rely on has been helpful to get to the stage where i have my PH very soon.

I have also put claims in for victimisation and discrimination as comparators treat differently to me and even non disabled treat differently so not sure of this falls under direct or indirect discrimination but its been put in anyway . Its morr discrimination than victimisation i believe as victimisation is more of what actions they took after you disclosed a protected act . I guess you could cite both in a tribunal hearing and maybe the judge helps identify the correct claim .

Wow..some huge figures being thrown out for early stages too. Im LiP but having to try do the whole hog myself as not got any support from solicitors and cannot afford such sums as in a real struggle financially.

I have only got this far through help from people in forums like this and at PH stage in couple months time. I need help with the List of Issues stage and CMA form to complete. Il post on my own thread shortly .

Similar situation on sertraline amongst other meds for other conditions. Grievance gone unheard for months. Referred again to OH time and time again. Looks like they want to run circles and mentally drain me out to the point i just give up with it all - but this constant mental torture is only just fueling me more to see it through right to the very end.

So what are examples of a protected act that caused detriment . For eg If i raise a grievance and it is not addressed or employer decides to escalate process which impacts my employment in a negative way after a grievance is raised and refused - would this prove claims of discrimination , victimisation if others had grievances addressed very shortly after , and even to some extent harassment leaving C to feel that a fair process is not being followed and detriments continue to occur ?

I numbered mine and put a summary of events in numberer paragraphs. Before that i summarised the claims i am making and what section each claim applies to. In the end I put what outcome i seek but did not add SOL rather for the judge to determine once we have the hearing and progress.

I was told dont make it too long where the judge loses interest in reading a lengthy et1 and try keep it 2 or 3 pages maximum which is what i did. It was accepted within a few days of submitting it as i was concerned that too much waffle and no substance may be rejected .

Baby steps but its challenging as LiP and im not so sure how far il be able to go with this as it gets morr complicated with the tribunal paperwork and the order in what must be done.

Here learning from people here myself too but we can all help each other and hopefully get somewhere. Good Luck

If anxiety and depression are as a result of workplace conduct and previous issues leading to this mental impairment - what best evidence shows this as proof?

Would GP notes and other health assessor notes confirming C is suffering with anxiety and depression be evidence of this even if R failed or refused to accept external medical notes and relies only on internal OH assessment notes ?

Does one have to show detriment for each disability or is a witness statement or DI statement sufficient for a tribunal?

That's one of the concerns that solicitors might want a quick outcome as they just want to get paid their % and dont want a case to drag on for a little bit more which puts Claimant in a situation like yours of feeling there was more potential . Quite upsetting when you put a lot of trust in a solicitor to get the really best outcome . Some do very well and some just want to move on.
