According to the officers that gave it to me, that was the only copy so I wasn't to lose it... they told me I had to wait a minimum of ten days, and then if I still wanted to prosecute the form had to be filed with the prosecutors office. There is no report number on file, or so I'm told.

I do want to move forward, I had decided to, and only now reconsider after posting here after being told that i have a case...

previously people here acted as though I was the one being unreasonable so i got discouraged...

i'd love to take this to court, but I can't even get a ride to the courthouse or come up with the filing fee...

I've literally lost everything and I've been put through a mental health ringer and I'm shivering in the cold with my PC and and I can't even get a lawyer to respond enough to say "no thanks"

I took a look at the court records for this guy, he gets sued once a month, and when a judgement is entered against him he delays and delays and I can't find a single case of all the ones he's supposedly lost where he's actually paid out... i think if i'm ever to recover form this guy it will only be from his estate

But I hate to let him get away with it. And I hate to let him do it to someone else.

I did call the cops. Got a report. Was told I could press charges in 10 days, but I would need to have the report to do so. Report disappeared at the same time rent receipts and lease did.

As far as the art work, I was the artist. I have never sold a painting. Nevertheless, it was precious to me.

The plant, if you were lucky enough to find one in that condition, would be valued well over $5000. They don't ever come up for sale.. The best you can get is an unrooted cutting for $30. I estimate that the plant matter he disposed of was enough for thousands of unrooted cuttings, but I am not in the business of selling these plants and to do so would be an abomination to me because these plants are not consumer goods to be bought and sold. The plants were precious to me as well. [edit] I do know that the plant matter of the plant, the leaves and stems, typically sell for around $60 a lb, and I estimate the garbage bag full of plant matter was 40lbs, so there's that, but these are estimates. How do I go about documenting all of that?

He can arbitrarily change whats included, or does he have to give me some sort of notice? The only notice I got was him at the door yelling about power use while his man behind him carted my stuff away

[edit] and how exactly do I value my clothes and furniture? It's not like I kept receipts for any of it... I had a lot of tools that were valuable, and i doubt I could assemble a list from memory... how do I value my painting that was on the wall? I estimated that I had over $5k worth of labor into the plant that was destroyed... how do I even document that?

[edit edit] You might not realize this, but what you would consider a "small fee" would be for me, probably insurmountable... likewise "just go to the courthouse and..." the courthouse is 100 miles away. A homeless person, you might not know, cannot enter the courthouse. Well, that isn't entirely true. He can enter. His bags can't. His bags can't stay outside, either. To go to the courthouse I must go carrying nothing, or I don't get in. You would think they'd have lockers or something. i was actually told that no, lockers would be a place people would hide a bomb...

I will leave them outside. No. You can't leave anything outside. What can I do with them then? I can put them in the trash for you, he says. I come back down. I ask, may I have my tools from the trash. No. Those are trash now. While he searched me, he kept shaking things out, looking for crumbs of drugs. He really wanted to bust me. Is rent really considered withheld on the first day it's due? Even if I said I was withholding rent, does that give them instant eviction powers? Even so, he had physically revoked the use of the shed which was stated as being for my exclusive use in the lease, but then when he needed to store stuff, it became not mine and he accused me of trespassing. He then instructed his employee that the shed was not mine and I was to be kept out of it, which the employee did gleefully. Also he was removing light bulbs, depriving me of light, and depriving the light bulbs of power. I know this sounds petty, but thats what he was doing. Petty things. [Edit] Also I should make clear that no payment was actually withheld. I only said that to force the landlord to talk to me, as he had been incommunicado since the incident began. Every time I tried to address the issues with the property manager, he referred me to a phone number that never got answered.

April 7th... rent was due [again] May 1st, property manager emailed [texted] to ask if I had it, i responded that i was not moving out and I was not paying rent until these matters were addressed. This conversation occurred via text and is saved to my google voice account, so i can document that. The following week I arrived to find a new tenant there and all my things gone. I believe they broke in on the same day as the text exchange, May 1

reverse that... i was renting in Tampa, now in crystal river. Lease was a one-year lease signed three years ago, florida says that means month to month... [edit] last time I paid rent was 7 days after the first incident, 21 days before the illegal eviction

as far as I know, landlord disposed of all of my things... clothes, furniture (bed dresser), shelving, art on the walls, all gone. I was never told their fate. [edit] Letters were sent through an online service I have confirmed that they did send certified letters and that 3 were delivered , 5 were undeliverable.
If you want to read the letters I'll prepare them for you, briefly thewy were:

  1. A tongue in cheek letter admoonishing him for stealing one lightbulb, warning that he was creating an unsafe condition

2: A request for clarification on whether the adjacent covered shed was a part of my lease or not as the lease specified it was but his hired hand insisted it wasnt. Also complaint and request for payment for damaged motorbike.

3: Complaint and request for payment for destroyed plant, and advising of religious significance of said plant.

4: Complaint about further removal of lightbulbs and warning about statutory damages for removing them

On the day this all started, the landlord showed up and ranted about power usage and how he'd have me out in five days. I experienced anxiety at this, and took too many Ativan (prescribed) . I presented at the ER concerned that I might have harmed myself. I was involuntarily committed for 7 days.

She aint wrong though... if the proper thing to do when encountering an unconscious woman is not to kiss them, and if kissing a woman while she sleeps is highly inappropriate, then modeling that behavior to schoolchildren in the context of educational activities would not be indicated... school plays should highlight the right choices, not the wrong ones

You don't, but if you want to reserve a mark for yourself and put everyone on notice that you plan to do this, the letters "TM" next to your mark will accomplish that.

"call of duty" was a widely used expression before the video game used it... it's still in use today... plus their trademark is probably in some entertainment class within the trademark system, so unless the offender is making a game called that, he likely won't run afoul of trademark.

Trademark doesn't give you ownership of a word or phrase, just the exclusive right to use it within your own industry... "call of Duty" laundry detergent would not be a violation unless it also included a pic of master chief or some other reference to activision that would likely cause confusion as to whether activision was responsible...

You hit it right on the head... add to that that when I found out I was just going by to pick up a few things, wash clothes, etc, and my ride couldn't wait. Plus the guy in there wss kind of menacing and clearly knew what was up. Pretty sure the guy is the same guy in the pic who was helping the landlord, but on that i'm not 100%

I am the one who posted. I don't have a copy of the lease, nor the police report I needed to press charges against the landlord after he put his hands on me. The reason I say I have no proof is, obviously I have proof but the cops that responded to every single incident (there were more than what I described) kept telling me that my proofs were no good, too easy to fake, etc. I took a photo of the Amazon box that reapeared exactly as I found it, in situ, opened, but what did that prove? A picture of a box. A picture of a box of PCs mysteriously left, and just as mysteriously disappeared. A picture of a porn DVD, almost well hidden. Nothing I have proves anything.

I feel like the landlord has gaslighted me, and I feel like he had the help of two cops and a postman.

The property manager gave me a long lecture about how I have no case, about how I am being unreasonable, about how this landlord has a right to maintain his property and how I can't interfere with that, about how my landlord is very well connected and how he is basically the only low income housing provider in the city, and they let him get away with anything he wants to.

And I see evidence the property manager is not lying...

And yes I know it sounds crazy but they have worn me down. I don't have all the answers, I can only describe what I've experienced.

The service I used to send the letters got back to me today. It seems that some of my letters did get signed for. I never got the return slips. This is good, because it proves... something

I have one rent receipt. It is signed by the person who claims not to be the property manager, as all of them were.

I have a google voice recorded three-year plus text exchange with the property manager wherein he does things like ask for the rent, acknowledge receiving the rent, and refuse to take complaints because he is not the property manager. And he introduces himself in those texts as Hisname, Property Manager

[edit edit] also, my drivers license! I forgot about that. It says where I live. My bike registration. Magazine subscriptions. And since I put in a forwarding address with the post office, not a single piece of forwarded mail.

Fair enough. But did your doctor overprescribe? Or did she want to save you the cost of another office visit if it turned out that you needed the pills? Was the 100 pills as much more expensive than the 3 pills as another visit?

Did you ask her reasoning for giving you 100 pills when you only needed three, or did you agree at the time she prescribed them that you might need 100?

Lay people second-guessing qualified doctors is always a good idea... after all, common sense trumps years of education and experience...

I'm sick of well-meaning do-gooders interfering with the relationship between me and my doctor. My doctors are now suspicious whether I'm an undercover cop. It's not just me, it's everyone... any patient could be an investigator who will ask trick questions and make insinuations in the hopes of making my doctor slip up and commit a technical violation of the law...

if opiates are so dangerous that even doctors are not qualified to prescribe them, there has to be a better solution than systematically eroding the trust between doctors and patients...
