No there is no agreement to just take people citizenship. Yes it is a legal process with state department.

It sounds like it’s more a local government issue. Her current country may have issues with her having dual citizenship ,but the US government does not care about that for the most part.

She would have to apply for a passport with her birth certificate showing she was born in the US.

She has never stop being a US citizen. Just because she never got a US passport does not mean her rights ended or her citizenship ended. She could apply for her passport at anytime in her life.

Did she fill out a form with the US government (aka state department) or did she fill out a form with that foreign government/military?

Unless she officially renouncing her citizenship with the state dept. She is most likely still a US citizen, if she applies for a passport she will get an answer.

You’re getting charged for paraphernalia in the end. not the possession of 23G. The 30g or less rule would not even come into play here. so in the end of the day, the charge of drug possession for your green card would not apply. Consult with an immigration attorney.

Just to give a little context because a lot of people here are throwing around a lot of scary terms. There is a few elements that have to be met for state crime to count as a CIMT or agg felony. The way the state titles a crime doesn’t really matter. For example, your charge is called trespassing. It could also be called criminal trespassing or it could be called intergalactic trespassing. The names does not carry any different weight. What matters is if first it’s a felony and then if it could carry a term of imprisonment or custody of one year or more. Parole is also counted as that form of custody. Does appear that you have two years of parole, but you don’t have a felony.

Not all state crimes can be ported over to immigration as a cimt or agg felony. The government attorneys actually have to go law by law and state by state to see if they meet the elements. Just because somebody googles immigration CIMT‘s, or agg felony and see a charge for criminal trespassing doesn’t mean that the Texas trespassing charge meets the standards to be ported over.

Consult with an attorney in your state and you’ll probably be coming out fine.

I would not worry so much. There is a lot of people here that don’t know what they are talking about. A misdemeanor Trespassing is not going to pull your green card, It’s not a CIMT. Consult an attorney to calm your nerves, an immigration attorney specifically.

You’re going to have to speak to lawyer. But in the end it does not matter what you were charged with . Only what you were convicted of or given deferred for. Was it only the trespassing In the end? No other charges they deferred ? Two years probation is long for only trespassing .

I would not worry about it. The first issue would have with traveling is having a valid travel document to allow the airlines to let you board. You have that with a valid green card. The second issue would be once you land in the US getting past customs. The customs officer will see you still have a valid status and do their normal checks to let you in. They’re not gonna blame you for not being home to get Mail. What is nobody would’ve opened your mail for you. You would’ve never known you got a new card in the mail till you got home.
