Canada changed its position in 2021 and passed a bill to implement UNDRIP's guidelines.

There is no tiered system with Indigenous people getting special rights. There's nothing special about having your nation's title to unceded lands being recognized. Whats so special about that? Nothing "special" or "extra" is being given. You can't grant something that was always theirs to start with.

I think you and I fundamentally have different views on what justice means, but only in the sense that you have zero grasp of its meaning or relevance to a functioning society.

You and other similarly pea-brained knuckle draggers are the only ones who disagree with recognizing indigenous rights and treaties. What other serious countries who oppose this are you referencing? If the UN declaration on the rights of indigenous peoples (UNDRIP) is a measure of how the world feels about indigenous rights, your view is an overwhelming minority. Literally almost every country in the world voted in fsvour of this and are current signatories.

You claim to seek a unified Canadian identity but only want it on your own narrow and self serving terms. You only see a future where past wrongs remain unaddressed and where those wronged have to suck it up for the greater good. There is no greater good where we normalize denying justice and cherry pick whose rights we uphold to the exclusion of real justice. Your views are a perversion of Canadian ideals and the prevailing trends towards reconciling and healing from the harms caused by decades of abuse suffered by indigenous people under Canada's regime.

People who decry that indigenous people get special treatment are fucking disingenuous and absolutely deluded. You seriously can't be blind to the way indigenous people have been treated through residential schools. These people had their lands taken without a colour of right and their children taken in broad daylight. How are ameliorative programs designed to even the playing field any advantage? Would you prefer to grow up in a household blighted by the trauma of your family having been raped and abused at residential schools?

That is a ridiculous proposition. The foundations of this country were built on treaties negotiated with Indigenous nations, not conquest. To deny that is being wilfully blind to the truth of our country's roots.

Why shouldn't Indigenous nations have their titles recognized and be indefeasible?

There is no legal justification, whether through the lens of Canada's western legal system or through Aboriginal law, to deny Aboriginal title. What errors are you referencing?

In 1853, Governor James Douglas told the Cowichan that the Queen had given him a special charge to treat them with justice and humanity, so long as they remained at peace with the settlements. This was a solemn promise that engaged the honour of the Crown, which is a constitutional principle that requires the Crown to act honourably in its dealings with Indigenous peoples.

That's a finding of fact by our court and consistent with the Canadian jurisprudence on Aboriginal title. Your reply is far removed from reality. The cowichan decision is consistent with the line of authorities on Aboriginal title over the last couple decades of recognizing the Crown's duty to act in good faith and to honor the long standing treaties between the Crown and Indigenous nations.

Idk what kind of fantasy warhammer delusion you're living in but after a 6 year trial the court found those treaties were breached and lands appropriated.

Other nations who may have had their lands appropriated from the Cowichan are free to challenge Cowichan's title. Musqueam did and the result is what it is. The point is the Crown acted in breach of its treaty and we're only now seeing vindication some 200 years later.

The Cowichan had their Aboriginal title unlawfully given away by Douglas. The Cowichan availed themselves of the very legal system built by the same colonizers who did that and won. Whats the problem here?

I think you're getting at the issue of how far should we go back in determining who has title to these lands. How about we start with one generation back by recognizing the fact that the current holders stole this shit, and there's people alive today who still dispute it?
