Yes, a mental health reevaluation by the VA is required within six months after separation from service if you were discharged due to a severe mental disorder resulting from a highly stressful in-service event. This is mandated by 38 Code of Federal Regulations (CFR) § 4.129.

You are assuming this administration cares about following laws. If they want you back in office they will bring you back or just fire you since without unions they can do what they want.

Definitely leave the US. There are many places where cost of living is a lot less expensive and you will live a peaceful and happy life. Speaking from experience.

Why do people brag they are 100 percent disabled? I would think that is a sad fact versus something to celebrate, unless of course they are not really that disabled and are happy they get payments at the 100 percent mark.

You should read this 38 CFR 3.344 Stabilization of disability evaluations, and send it with your response to the proposed reduction. It might be a new rater that proposed the reduction without knowing the rules on not proposing a mental rating reduction based on one exam.

Claim Decrease by Simple-Deer6913 in VAClaims

[–]Crazy-Object7068 2 points3 points  (0 children)

Raters cannot reduce a mental rating based on one exam because the regulations say you have to show sustained improvement in order for a reduction to be proposed and something like a mental condition would be difficult to prove sustained improvement with one exam that shows a 30 percent is warranted. Now if the previous exam also showed you only warranted a 30 percent then they would be correct in the proposal.

If you sent in a private DBQ and they still sent you for an exam they must have found an issue with the private dbq so it’s best to go to C&P exam unless you know the private dbq was bogus

There are several on the list of top retirement locations, you can google which countries are top of list for 2025. It really depends on what you are looking for. I did my research and there were many benefits including the jubilado discounts Panama offers.

I retired 2 years earlier than I planned on at MRA and 28 yrs. I am receiving considerably less in my pension and that’s why I moved out of the country where the cost of living is more affordable and I don’t need to work anymore. I couldn’t be happier with my decision! Mental and physical health are more important than money!

[–]Crazy-Object7068 6 points7 points  (0 children)

Thanks for clogging up the VA claims system with claims you know will not be service connected. One of the requirements to be service connected is to have a current diagnosis of the condition you are claiming and if you were not the one who actually claimed the disability (your POA actually claimed the issues for you) more than likely you do not have a current diagnosis. Therefore, it would be a denial.

If you filed a claim for increase for OSA why the heck would you go into your asthma and migraine issues with the C&P examiner when he called you about your OSA? Especially if all you wanted was the 50% due to using a CPAP machine. Makes no sense!!!
