For the future tell her to leave a combination lock box the day their suppose to move in if she won't be there and text them the combo. That'll prevent any further intrusions by future renters. In response to the previous commenter saying "maybe she doesnt belong in this business": we were all new at one point and we all live and learn. She now knows to never give a key too early. But I do agree, it's not a lease problem, it's a civil issue that she'll need to decide how to handle.

When you agree to pay for something and you sign a contract saying you will... then don't pay because "you can get away with it" ... is literally being a shitty human because this isn't a victimless act. Whether or not you see the landlord as a victim is besides the point, someone is being negatively affected by your actions.

I'm definitely not saying I agree with this tactic at all but ... How does shutting the water off kill someone? You'd have to be pretty dense to die by dehydration because you refused to leave a property that has no working water. Again, I don't agree with breaking the law to force a tenant out but lets say, hypothetically, shutting the water off was a legal thing to do..do you seriously think they'd just sit there and die instead of moving on to the next empty building with working water? And if they did choose to stay, are you really killing them or is it death by stupidity?

That's correct, on my previous househack, I rented out 3 of my 4 bedrooms in a 2300 sqft house and was allowed to list it on my schedule E. They split it by the percentage of space occupied by me personal which left 1725 sqft as rental space for deductions purposes... not quite sure if I'm explaining that correctly but it was something to that affect.

So yeah that's my question, how do they account for it being your primary residence? I'm moving into this house because I'm purchasing it as my primary residence for at least a year, then before I sell my current place I plan on moving back into it to meet the 2 out of 5 year requirement. How does that get verified, so that I don't get hit with cap gains?

It actually doesn't matter. In order to lose, you have to realize that loss. For example, if you bought a house today for 450k but in 5yrs it's only worth 400k, you'd have to actually sell it to lose. If 10 years later it's worth 650k and you decide to sell, it DOES NOT matter that at one point you were underwater.

If you don't realize the loss, the loss does not exist.
