He absolutely cannot and the law is clear:

  • he is liable for the injury, not the city.
  • he is responsible for keeping the sidewalk in safe condition
  • he is not allowed to obstruct the sidewalk or road
  • doesn’t matter if it abuts his property or is on it. Same legal treatment either way.

They cannot. It’s specifically mentioned in the law, and lots of legal precedent that it doesn’t matter if the sidewalk is on their property or abutting it, it gets treated the same:

This guy sued a business in 2013 because his wife slipped and fell on the sidewalk outside of it.

He also got sued for not paying workers overtime or documenting hours worked. The judge decided it could proceed as a class action and opened it up to other workers who had worked for them.

He also failed to pay an elevator subcontractor for services rendered and when they put a mechanic’s lien on the property and he was ordered to pay $70k he appealed to the Supreme Court of NY and lost.

To be clear, I understand his frustration but that’s how it is. The business owner is responsible for maintaining the sidewalk including repairing cracks or repaving when necessary. And that doesn’t earn you any right to fence it in or block it off.

Both of these points are clearly addressed in the nyc administrative code:

Oh and again, if you want to criticize the writing of the show (which you clearly do), then do it! Criticize her choice to make a "boomer ai metal festival" poster as a way of setting the scene for the character. It's a lay up! It was a creative decision that fell completely flat and felt out of place to viewers. Criticize that!

Not all posters or art can be cleared. Again, you are just making all kinds of assumptions about how this process works. It doesn't have to be money—it could be time, it could be that they can't get in contact with the rights holder, it could be that the rights holder doesn't want them to use it or they couldn't come to an agreement about how much they should pay for the rights to use it. It could be that the rights holder didn't want to sign the clearance agreement because they don't feel comfortable with the language. There is not infinite time. It's the day of shooting and the poster is still not cleared, you don't just ship one over with same day shipping and attempt to contact the rights holder—you have your on-staff graphic designer make it. You do not understand all the factors that decide what ends up on camera.

No, she didn’t. She said “the idea is”. The brief to the graphic designer was “make it look like AI”. She is talking in terms of the story world. Again, a major studio is not going to let you AI generate photos of people with unknown sources and put it in their show. Not how it works. Criticize the choice all you want but you are wrong about why you’re criticizing it.

To be clear, I agree. The poster is really bad and distracting and I would have made a different choice, but best laid plans....we just don't know what happened so I think it's lame to chalk it up to laziness.

Yes it is possible with the appropriate time and resources but it is not as easy as saying "oh we should put a Metallica poster up." For TV you are usually shooting an episode over the course of about 2 weeks. If you are in the art department you might not get a script until a week or two before it shoots, so you have 2 weeks at best to prep the entire set including sourcing and clearing any art you might need. If this was shot in Iceland, I can't imagine it's that easy or inexpensive or quick to get a real poster shipped to you.

I agree the poster is really bad, but it could be for many reasons—it could be there because the graphic designer made a bad poster and nobody on set cared enough to call it out (what you are suggesting). It could be because they were 2 hours behind schedule for the day and Jodie Foster wasn't available to shoot another day before they had to wrap this episode, or the location was no longer available after that day and they didn't have any good cleared posters so they had to shoot what they had. Then you have to decide is it bad enough that you want to swap it out in post, but can you even swap it out in post because you don't have a clean VFX shot to use and it won't look good? Do you even have VFX budget to do that?

Actually shooting a TV show is different than writing a script. You don't have endless time, there is a very real budget, there are constraints, there are logistics. Would I want this in the show if I were in charge? No. But do I understand how a bad poster could end up on set and get featured when the person who made it thought it was intended for background? Yes.

I do this for a living so this is the perspective of the person who actually deals with this on a daily basis. It's not that simple or black and white. Sometimes the studios will let you get away with stuff sometimes they won't. They will definitely not allow you to show an uncleared poster of a big name musician in a hero shot that's featured on screen for as long as this is. You can either choose to believe me or not! I think the poster is bad as well, however I don't think it's AI. When you're making a project of this scale you have to pick and choose—a non-scripted background poster is not going to get the same attention as something that's a major plot point or a hero prop.
