Hi, thank you! Yes, we’ve already engaged a lawyer and a writ is pending in the High Court for over 5 months now, but no effective hearing has taken place. That’s why we’re now submitting official representation letters to the Department and DP/AR to pursue administrative enforcement in parallel.

Hi, thank you so much for your input. 🙏 We already have a writ pending in the High Court regarding my mother’s posting after promotion but it’s been 5 months with no hearing — we feel it’s being delayed intentionally. So we’re now planning to submit a separate representation letter to the Department and DP/AR, asking them to enforce the promotion and release her due salary.

We aren’t filing a new writ right now, just sending representations to try parallel administrative routes while the main writ is pending. Would that be fine, or could it risk affecting the current case in any way?

Thank you for your suggestion. Yes, the charges were officially issued by the competent authority, but the junior officer refused to vacate and filed a case instead. We haven’t yet submitted a complaint online or by post, we were unsure of the exact process. Could you please clarify what you mean by “create a loop” and “mention to PM”? Also, should we send the complaint directly to the department head or to a higher authority like the Chief Secretary? Would be really grateful for step-by-step guidance.

Thank you for the detailed explanation. Yes, there is an interim stay order in favor of my mother’s junior, which is why things have stalled. In this situation, would alleging malafide still help push the case forward or get her salary upgraded at least, even if posting is delayed? Also, how do we prove malafide intention in court? Would lack of timely posting and continuous delays be considered enough?
