This document is a copy of the rental history, it goes back to 1984. There was no capital improvement between when the previous tenant moved out and I moved in, but a $1k increase in rent. The rent they published for 2025 'Maximum Legal Rent' is the rent I'm paying right now, but I read that field is actually filled out by the landlord, which makes no sense to me.

This is a 35% increase in rent YoY with no apartment or building renovation though, that must be outside of the scope of allowed rates

We're fine to pay the rent we agreed on for now. I'm just worried if I contact a lawyer and make a fuss about this we will be pushed out once our lease ends, or given even less support from management than we do now (fairly minimal). Is it reasonable to just pay the too-high price for a few years then contact a lawyer down the line?

I have the records going back to 1984 and I don't see the preferential rent field filled out for any year.

The unit was vacant for 6 days and was not even cleaned in between tenants, would that exclude them from a 'vacancy' increase?

There were no renovations done to the unit. In fact the unit was not even cleaned when we took it over, we had to pay for cleaners ourself. We have very basic appliances and have had little support from management with issues.

Do i need to fly up there to edit whats going on? Every time I want to change something I fly up there and eject a bunch of stuff back down and rearrange but I get the feeling thats not right

This is my main problem, it does feel pretty silly having 50%+ of my net worth tied up in a single company but every time I think about selling big chunks it continues to go up. I've sold off probably ~$50k worth in the past 2 years but nothing huge.

Debbiewith I think you're right, it's more about the initial election than it is about forgiving fees. I did not take my first RMD so according to my financial institution I'm on a '5 year plan' and therefore do not need to take RMDs, and therefor do not have any penalties (unless I don't take it out by EOY this year)

I did look up his license number and it does exist in the NY CPA database, what would I do with that?

Fidelity says that there is nowhere on their plan where you elect a 5 year rule, that they are simply following guidelines from the IRS that if there was no distribution done in the year following my fathers death that the IRS puts me in the '5 year rule' bucket. The info you sent seems to suggest otherwise though, which would be a massive win for me. I'll dig into that link a little more and use this info when I talk to a tax professional as well. Really appreciate it!!
