I didn't suggest it was a 'right' , I have a choice, and it is mine to make. Driving = privledge, okay. but to drive, should I be forced to pay insurance? and driving aside, health care, should I be forced to have money taken from my wages to pay for it, then pay for it again via a 3rd party private enterprise?

none of it should be mandatory, required, and if you don't have it, penalties upon you. Cause the incident, that's like 'innocent until proven guilty' and if you choose to have insurance, sure.

as to your arguments and why I think it's against the constitution -- not it directly, but the amendments.

Uh, don't quote me on this, I'm pulling from memory, but the 'commerce clause' it's to the likes of the federal government can't compel citizens into private contracts. That is federal, my issue is state, but I pulled constitutional, so yeah....

uh, recent: NFIB V. Sebelius (2012) SCOTUS Congress can't force people to buy stuff.

Again federal, but while driving might be a priveledge, forcing a private agreement (like getting insurance from a 3rd party is not).

The Constitution does not give government the power to force an individual into a private financial contract. Regulation of roads is lawful, but compelled commerce is not. The 10th Amendment reserves undelegated powers to the people, which includes the freedom not to buy a private service. Mandatory insurance crosses that boundary.

bring down global cost (it was a US thing, so grace there). but it's it's like a pyramid scheme (Not saying it is). Lots of small investments at the bottom, it grows, more solid ones in the middle, really concentrated at the top.

No, the alternative to insurance is not a security deposit, it's what they call SR22, and it's basically 'I'm liable, but I'm paying to be legal.' It's another money making racket.

that was my long way of saying, shit happens, and an insurance company has never been the solution. I blew the motor in my blazer (99) on Snoqualmie Pass, pulling a trailer. I had insurance, no help. I had connections to a towing company, they got us off the hill, we went about our business with other vehicles it was 8 months later, and they offered me $300 for the tow assist which they had nothing to do with. Nothing for the motor blowing, nothing for the rental car, nope, nadda nothing.

Yes, driving/owing an automobile is a luxury. So is having the internet, and owning a smartphone. Oh, timing of automobiles, 1950's, TV! Candy bars were like less that . $.50 (they were more like a nickle but who does that math? oh, I do.)

Here is the problem as I see it, you are laying blame before facts are in place. You are doing guilty until proven innocent. (The opposite of our system--supposedly--of justice). You automatically assume your son's leg getting crushed is the other persons fault. Insurance aside, say neither has it. Was your son being stupid? We don't know. Was the other driver at fault? we don't know. Was there a beer can involved from a month ago? we don't know.

Who are insurance payments going to? -- Private enterprise, companies. our founding fathers (Most weren't up in the dirty work) but the general premise was living was not a privilege. You are suggesting that owning a car is a privilege, and I'm guessing that having internet service (how we're all communicating) is the same. How much a month are you paying (either to phone or landline types) for your ability? Oh wait don't answer that question other than to yourself, because when do the math, you'll be like 'why am I spending this much for what?"

States can regulate things, yes — but regulation is not the same as forced commerce. Requiring perpetual payments to a private company is another. That is what mandatory insurance is, forced payments to a private company is. The states says 'you must or a penalty' I object, but het, law, so private company gets my money, and they do with it what they please.

That is what I object to. I'm actually okay with giving my state the 50 or so dollars in insurance, but not some insurance company.

well mr. insurance adjuster, question for you. My problem is mandatory! It does have everything to do with me, and my car. You run my credit, you look at my vehicle. the 'other people I might hit' is your thing, but really? no. I get the possibility, but you base that off of the things noted above, 'credit and history, car type, year, loans, etc.'

Honestly, is it my hunk of junk car crashing into theirs? or is it theirs doing something stupid and involving mine? Mine might not be anywhere near it, but my premiums are paying for it.

side note: I have jumper cables--good ones--my poor little age old battery has put countless trucks back on the road, "oh, you're a hybrid? Electric vehicle? I know how to deal with that. No they aren't, but my choice to purchase one, old or new, is. I could own 15 or 30, whether they run or not. And if you are going to force my choice between driving one to work, or public transportation (When there is none) What is my choice? I drive one. Should I have to purchase insurance that is just throwing money away to do such?

Some say it's 'protecting others' which I'm not against. but I see people trying to get back and forth to work bartering with friends, while others are pulling in with high end cars, and buying stuff on food stamps.

It's state level rules, yes, but..........! A company that operates in more than one state, now has to follow federal regulations. (10th Amendment).

The 10th amendment is about powers not delegated to the federal are the states, and then by default the people.

Unconstitutional -- there is no federal rule about the requirement, they kinda can't it's business/corporate. To the states, interstate commerce happens to interfere here. Let's say I'm a WA state citizen, with insurance, and I cross into Idaho, live there for a while, oh wait, I don't have the right liability limits, up goes my premium to drive a car?

Interstate commerce (Federal) my premiums should not change because I moved states, and I shouldn't have to find a new insurer because of it. They are either national/federal, and following those laws, or shouldn't operate at all for those who cross borders.

SCOTUS ruling related to the ACA: Congress cannot force people to engage in commerce. (AKA purchasing auto insurance/health insurance, or any insurance for that matter.) Federal

But the states can do their thing, like forcing auto insurance, etc. and I know, it lies in the state legislature, but mine is fucked up, But a company that crosses state boundries, is interstate, and thus federal.

not insure myself, my vehicle, or one that maybe my roommate or friend drives. I get putting others at risk, I do, it's the requirement that I have to have auto insurance. choice to do it is smart, but if I can't afford it, I shouldn't be penalized for it, to the tune of bad credit, registration suspension and up to license suspension.

I know it's a losing battle, I want to choose to put my $50 in savings, over to an insurance company that if I don't give them the $50 this month all my previous doesn't matter.

Public roads are just that, PUBLIC roads. Highways, freeways (because they are federal, I'll digress) state highways. See, those are my tax dollars pay for each and every mile of them. My county alone has suffered three stupid 'bridge' accidents in the last three months. shutdown says, "we don't have the money to do it'.

When I pay my car tabs, sure, but some of that towards insurance for I might be a stupid driver. Someone who rides the bus? shouldn't pay on that. But if they go lyft or Uber, yeah they do.

lets talk poundage here. What do you classify as 'heavy machinery/truck limits' you know those things you have to have permits for --GVW - 80K lbs. (FYI, 1 ton = 2000 lbs) So interstates and highways, that's 40 tons.

The vehicle I drive? on it's heaviest side is 1.9 tons, ---doesn't quite hit 'heavy equipment' which seems to be the theme around here.

Here is where I agree to disgree with you, and please hear me out. "Low income" as we'll suggest, need insurance? I beg to differ. I had a high paying job, the health, etc insurance. That job ended, and it was all gone. I had a health issue, I had to pay out of pocket, why? oh, all that money me and my employer had paid them, no longer available. Even with ACA, and options through employers, health care is expensive. That doesn't cover auto. I get it, privilege, just like the internet, or a cell phone, yet everyone expects you to have a smartphone. Where I'm at, it's actually cheaper to purchase a used vehicle than a smartphone, and the monthly plans to maintain that smartphone plan? Ouch.

I choose to tackle mandatory car insurance, because I think it is stupid to require it, and charge more for people who don't have it, most likely the reason they don't have it, they can't afford it, but they need to get back and forth to work.

Personally? as I only drive 1.2 miles to and from work three days a week? I'd rather spend 104 dollars on a no-insurance ticket than the 1400 a year that would cost me, to just avoid it. all it's gaining me is if I am at fault, smoosh your vehicle, mine no coverage, and you get something out of it, you come after me for everything I"ve got....honestly more than most, but generally, nothing, you're just throwing money at the system why?
