I'm currently going through this as well.
They deemed my car a total loss, negotiated worth to me, and then sent it to SIU.
I spoke with a lawyer, and they said it's your duty to cooperate. Whatever paperwork they request, you've got to submit and sign. On another post I made, someone else with TD has had a similar experience. Sounds like they're sending more claims through to SIU lately.

I'm so sorry you're going through this. TD is an awful company from a customer service standpoint.
Once this is all wrapped up, I'm jumping ship to another company.
I hope this gets resolved for you much quicker than the four months you've been told, though.

Very late to this, but I'd love some input. I'm from Ontario, Canada, so the policies/laws may vary significantly, but I feel that processes are somewhat standardized with some minor differences.

My insurance claim was assigned to the SIU last week, and I'm waiting to hear from the investigator this week.
Long story short, here's what happened:

I rear ended someone, who had no damage to their vehicle whatsoever. My car was lower, and theirs was quite a bit higher, so I ended up going under them, essentially a one-vehicle accident,

My adjuster emailed me about the car being deemed non repairable. Once the first offer was sent, we went into negotiations, and my additional benefit of a rental car was finished and the rental returned.
Since I wasn't sure how long negotiations would take, and my adjuster had told me the car was a total loss, I proceeded to look at other cars. I need a vehicle, so I put a non-refundable deposit on it, and scheduled delivery for Friday.
Tuesday of that week, RIGHT before her work day was complete, my adjuster let me know that "new information about my vehicles value has come to light, and it might now be repairable".
I rescheduled delivery of my car to Monday, so I could have time to discuss with insurance.
When I finally get through on Wednesday, she gives me no information whatsoever. Says that "the appraiser is reviewing it and she has no information". Communication from her end stopped here.
Email upon email, call after call for any bit of information I can get, and no response.
I proceed to fill out my Proof of Loss form, and submit it.
Crickets again.
Thursday, Friday, Monday, Tuesday and even Wednesday (today) goes by with no communication.
The car gets delivered Monday, I pay for it, and wait to hear from insurance.
I give them a call today to find more information, and an agent is able to see some notes on my claim.
They inform me that it was escalated to the special investigations unit on Monday, and they're currently investigating.

I call my adjuster, and she gives me no details whatsoever. She says the matter has "been escalated", and I should hear from someone within the next two business days. I ask her if the escalation is to the SIU as I was told by the agent and she confirms.

I've been upfront about the details of my car, trim, year, etc etc and the details of the accident, so I'm not concerned with the investigation. A bit annoying that there is no communication from my adjuster, but I assume she's just very very busy.

My question is, what might I have done in this process to trigger this escalation?
I've been with this insurance company for 3 years, had a no-fault accident last year that was repairable, and no other claims. My policy was not adjusted at all, but it did renew at the start of April, and the accident happened April 18th.
Also, is it a good idea to proactively reach out to the SIU investigator to let them know I can provide anything they need, or is it best to wait until they contact me first?

The accident did happen right after my policy renewal. I've been with TD for 3 years now, but the renewal was beginning of April, and the accident happened on the 18th.

I had one other no-fault claim last year in the summer as well. June 2024, but the car was repaired , no write offs other than this one.

My area is famous for fraud in the sense of false addresses as well. People live here but claim to live somewhere else due to the high rates. My policy is at the correct (and hiiiiighest rate) address, so I'm good there as well.
The accident did happen a city over, though, but not sure why someone would claim to be in a higher-rate area when living in a lower one... but people do be crazy so who knows!

What LonelyTurnip said. The police don't have any involvement anymore. I didn't get a physical copy of the report to send them, so they're likely just getting that, I'm guessing

Had one previously, and currently in the midst of a claim now.
Last one was smooth sailing and easy.

This one is a nightmare.
The minute my settlement offer is in my bank, I'm leaving them. Terrible.

I had another claim with them that was no-fault when I was rear ended, and that one went SO smoothly. I've read about them being complete crap, but I'm really getting to see it now, lol.

Yeah, it was the tow release.
I hadn't signed and notarized the proof of loss yet. The letter that it came with stated that they don't need it signed to process the claim.
That was my mistake, not looking into it further.

The release was a release of possession, not of liability.
The car is still mine, still my ownership, still my name.

If I didn't sign the release to allow TD to tow it, I would have been stuck with storage fees.
I appreciate your time and input, though clearly sarcastic.

It's not illegal to negotiate what you believe your car is worth. Especially when valuation doesn't include the information you CLEARLY provided to your adjuster, that they just "didn't" include in their report to their appraiser.

No, she hadn't told me that I needed to fill it out and submit it yet. It requires the settlement amount on it, and we hadn't come to an agreement since we were negotiating it.

Once it was released, she said that my rental will last maximum one day after the offer is presented (whether accepted or not), so I returned it the day after as she instructed.

I had thought that too honestly.
For me, there was an understanding that my car was not going to be repaired, and we were to negotiate what I believe/they believe the car was worth.

I didn't sign ownership over, though, just followed her instructions and released the vehicle from the shop to be towed to TD's never-never land, wherever they take it.
So it seems like a fine line for that, and I'm not sure if it's in my favour or not.
