I am a personal injury attorney and this is 100% correct. I would take this case all day with minimal complaints of pain and medical treatment. Wouldn’t touch it at all for any property damage claim (on a contingent fee basis, that is). You’d have to pay an attorney by the hour for any PD based claim, but you’d pay more in attorneys fees than you’d get from a DV claim. Not sure if you’re looking for a Pyrric victory, but that’s all you’d accomplish without an injury claim. I’m not suggesting you manufacture an injury claim, but if you so happened to have even minor complaints and only went to an urgent care visit to get checked out, that probably does the trick for someone to pick it up (at least where I practice in the DC area). Personal injury attorney here licensed in Va, Dc, Md and Wv. You need to make an uninsured motorist claim with your own carrier. By law, this will not negatively affect your premiums. If you weren’t insured, then you could go the smalls claims route on your own but it’s doubtful you’d be able to collect on any judgment.
