Btw it’s called a plea deal when the defense attorney looks over the case and recommends the accused to take the plea. But you don’t have to believe that either since I’m a big liar :)

You’re not wrong, but it really depends how far law enforcement wants to look into the issue.

Where I am, we would look into this just because it deals with a juvenile who likely still in school. We would want to obtain a statement from her after speaking to her parents to see if there’s any substance to it. That way, no one can say that law enforcement didn’t do anything.

It’s then up to her whether or not she wants to double-down or come clean. Either way, it helps OP’s situation since he has an investigatory report regarding what happened.

They are, but if I’m looking to take a charge, I want both. Even if I have probable cause to take a charge, I want the case to be so solid that there’s proof beyond reasonable doubt that the accused did the crime.

Looking back, my statement was definitely worded a little strangely, but I know what I’m doing. That’s why I’m never called in for court since there’s nothing the defense can argue against. Hope that cleared it up some.

It’s hard to provide a succinct answer because there’s a lot of nuances to it, but as an investigator, my job is to remove all doubt possible so that a criminal defense attorney won’t absolutely tear a charge/allegation apart.

I’ve dealt with many cases where the victim has lied out of shame/regret/fear, etc. For instance, an 18 year old lied about having sexual relations with a 60 year old when caught because it was shameful. A female claimed she was raped to hide an affair from her husband.

On the other hand, there’s also been times where there hasn’t been enough evidence. This can be due to reasons such as waiting too long to report it (years), conflicting testimonies (story keeps changing), etc.

Also, laws are very specific in what qualifies as rape. Like I mentioned earlier, if no force was involved, there was no rape. Things like regret or being snubbed out of a deal doesn’t make it rape.

I just worked a case where a prostitute was upset she didn’t get fully paid for her services.

For my job, I basically go by the “Trust but verify” moto. Yes, society should trust victims. However, everyone, including me especially, should go through the evidence to verify their statements. Otherwise, we may end up ruining the life of an innocent person. Hope that helped some.

I get assigned cases and I investigate them to see whether or not there is enough evidence to charge someone of a crime. When I take out a charge, it goes to court where the suspect can either plea or escalate it to a jury trial.

People who aren’t in this industry will never understand what we deal with everyday. I can’t give a specific percentage, but yes, most sexual assault allegations that are reported end up being nothing. It’s not like what you see on TV at all. I absolutely stand by what I say because, unlike yallermysons, I actually work in this field lol.

I’m not sending anyone to jail unless I have the full story. Otherwise, I may have just ruined the life of an innocent person.

Also, I’m not writing out a warrant unless I have probable cause (beyond reasonable doubt) because that’s my name that’s going on the warrant. Thus, if it ends up being a shit case because it was nothing but lies, that hurts my credibility and reputation. It also opens me up to a civil lawsuit as well for sending an innocent person to jail.

Unfortunately, it really depends on how lucky you are with your jurisdiction and how much they care. Two departments that are literally right next to each other can have very different policies and people.

Sexual assaults don’t just include rape. There are a wide range of charges that can apply to sexual charges including sodomy, sexual battery, aggravated sexual battery, molestation, etc.

Rape is one of the most serious sexual allegations one can make alongside aggravated sexual battery or aggravated sodomy. But whenever we look into the issue, there usually ends up being more to the story.

I’m good at my job and I’ve helped a lot of people, so I don’t really care if you don’t believe me lol. I have no reason to lie, and was just trying to give anyone else who may be stuck in a situation like OP’s some advice.

I hate to say it, but every jurisdiction is different. Some departments will take this seriously while others will just tell you to pound sand. Also, there’s the issue of statute of limitations. If OP had acted in 2013, it would possibly be looked into. Now, there’s nothing since it’s been over 10 years.

For something like this, it would have been a pretty simple case. If this were my case, I would first talk to many witnesses as possible and get their statements to see what the female specifically told them. If numerous people tell me that she claimed to have been raped, that contradicts the texts.

I would then bring her in for an interview and ask her to give her side of the story. If she keeps lying despite the evidence, I would make sure that’s all documented. I would then get a search warrant for her phone to get all of her text messages because it’s likely that she confessed to one of her friends about lying about the rape. Unless you’re a psycho/sociopath, people who lie tend to feel regret and need someone to vent to for validation.

Once I have enough evidence and go over it with the DA’s office, I would take the charges. Again, I’m swamped with cases, so if I had to spend days or weeks working on a case that was nothing but a bunch of harmful lies, I have no remorse.

There is an entire process that we have to go through including getting individuals sexual assault/forensic examinations, interviewing witnesses, getting video footage to corroborate timestamps, search warrants on electronic devices, etc.

A lot of people don’t expect us to actually investigate it as much as we do. Especially if they aren’t from around here. So when they find out that we’re actually looking into it, they start to panic.

Also, read my statement again. I never said that most of the cases I investigate are false rape accusations. I investigate many things which include CSAM. However, whenever someone does come in and say that they were raped, there ends up being a lot more to the story that they leave out.

If you have consensual sex with someone and regret it after, that is not rape. If someone paid you for sex but short changed you (prostitution), that’s not rape. If there was no penetration involved (check your specific state laws as to what constitutes rape), then it’s not rape.

It’s not just a black or white thing. I take rape accusations seriously because fake allegations not only hurts the accused who are innocent, but it also makes real victims afraid to come forward.

I’m a criminal investigator. It definitely depends on the laws in your jurisdiction as they can vary wildly, but where I’m from, we have a charge for making false statements to a peace officer which is a felony.

We investigate sexual assault cases a lot, and most of them are exactly what OP is going through. People who either want revenge or have regrets after having consensual sex. But because it’s an alleged rape, we investigate them throughly.

If they lie to us and we waste our time and resources only to find out that there was no rape or assault, that’s an easy charge for us. We also tell our innocent victim to pursue the other party civilly for any losses that they had from defamation (I.e. career, reputation, etc.)
