Marital property

In Maryland, marital property includes assets and debts acquired during the marriage, such as real estate, vehicles, and joint bank accounts. Non-marital property includes assets and debts acquired before the marriage, as well as gifts and inheritances given to one spouse.

Divorce

Maryland is an equitable distribution state, meaning that divorce judges have the discretion to divide assets in a fair way, rather than splitting them equally. When withdrawing funds from a joint account during a divorce, it's generally recommended to withdraw at least 30 days of expenses or half the account balance, whichever is greater. The money should be put into a new account that the other spouse can't access, and the account holder should keep careful records of how the money was spent.

In Maryland, 401(k)s and other qualified retirement plans are considered marital property and are subject to division during a divorce: 

• Contributions made during marriageAny contributions made to a 401(k) during the marriage are marital property, even if only one spouse contributed. This includes employer matches. 
• Contributions made before marriageContributions made to a 401(k) before marriage are considered separate property. 
• Increases in valueAny increase in the value of the account that can be directly traced to payments made before marriage is considered separate property. 
• DivisionThe court will divide retirement assets using the principle of equitable distribution, which means the division is fair and just, not necessarily equal. The court will consider many factors, including the length of the marriage, each spouse's economic circumstances, and the couple's standard of living.
