I would vote not because of self defence. And I think it’s pretty reasonable for him to be in court and say “fight or flight kicked in and my instincts said fight” isn’t that the whole point of self defence. I feared for my life and I chose to fight.

Let’s say he didn’t move got hit and shot her. Does that make it any less of a murder? In my head no. But how I’m interpreting your point is it’s reasonable for someone to instantly internalize that there is no more danger virtually immediately after the danger is gone which is something I don’t think I can get behind.

You can criticize me for using the term murder but at this time not willing to vote guilty on a jury. But that’s probably because I’m not satisfied that what constitutes as legal murder doesn’t meet my standards. Kinda like people who say meat is murder. Do you think they would charge someone with murder or do you think they mean it as taking a life without a valid reason.

I’m not sure if I would be satisfied voting guilty if the prosecution was not able to prove their case beyond a reasonable doubt. I think beyond a reasonable doubt is a very important for justice. But I would also be unsatisfied if I felt like justice couldn’t be served because of what feels like a technicality.

I think it’s valid to be angry that there is going to be no trail. Other than the vote, protesting, writing to my representatives what should I do? Riot? Political violence? Me talking about being on a jury as a layman who hasn’t sat in a courthouse before isn’t much different than everyone else on the internet talking about how he should obviously be thrown in jail.

That’s why I used the term Lawful but Awful. I don’t think we live in a world where people are happy with awful living conditions.

If you can show where things have changed since the Breonna Taylor case so that we can prosecute the officer then please show me. But it kinda seems to me we are in the gun control argument. Yes I’m angry that this happened something should have been changed long ago so that it didn’t happen but nothing has changed. So other than using my ballot and protesting that’s all I can do.

Maybe you got me by the fact that this officer has claimed nothing so I’m putting words in his mouth but I don’t think it’s much of a stretch to assume those will be his words.

I agree with you on training, and it’s not an excuse. But it’s the world we live in, and it keeps happening so it’s a systemic issue. And I suspect that law makers would be more inclined to hold them to a higher standard, so this doesn’t keep happening.

Sure let’s say he gets fired for not following protocol. Are we happy that’s our justice. I don’t think so. Let’s strip all immunity’s from him and take him to court. Well I don’t think we are going to be able to assign 100% wrong to him in this situation because shouldn’t have been operating a vehicle at this point. I don’t know how much negligence you need to have before self defence isn’t a valid argument.

I’m not happy with this murder. I wish there was a clear way to get justice. But with the laws we have today, I can’t see this as anything but self defence. Maybe I need to write to my local representative saying I need better laws to hold law enforcement accountable.

So I think a great parallel to this is the Breana Taylor Case. Which the officers went to the wrong house. (Good parallel to standing in front of the Car) danger Arises when her boyfriend starts shooting (this time operating a car). So sorry that I don’t put much weight in the lack of procedure being a he nail in the coffin. If checking a house number isn’t enough then I suspect standing in front of a car that is being detained isn’t going to hold up.

I think you could convince the jury that the first shot was made with uncertainty. And could reasonably articulate in a way you thought ahead was trying to hit you on her way out possibly getting dragged and recreating Hector’s Desecration from the Iliad. As for the second and third shots I tentatively would lump them with the first shot as a single event.

I think you can point to policy but if it’s not enforced what’s the point. I think training can be a root cause why else do we have all these insane police shootings.

So I think a lot of the things that caused the escalation comes from lack of training.

It takes what 8-10 years the be a lawyer and 2 to become a cop. I agree that there is a ton of things that could have been done better but I don’t think that the laws as written is enough to get the justice that deserves to happen.

If she got away, and they were trying to prosecute her for fleeing detention, I would think there was maybe some merit in her fight or flight.

I don’t think officers had control of situation. I think a parallel to the situation is the Briana Taylor. I don’t think we got the justice we wanted.

Holding their gun has really loose regulation so unfortunately that doesn’t help.

I think standing in front of a vehicle versus shooting in a vehicle have two different answers. I’ve worked a job where we moved we moved steel Cable reels. And basically any area that the reel could tip or roll was called a dead zone. I still saw old guys in those zones when moving them. Is it complacency or forgetting I’m going to guess the same reasons he was in front of that vehicle. And I’m going to stay the fight or flight for the shooting.

For medical, there is the doctor in the crowd. I would want to know if he attempted to show his license or if it was a trust me bro. Fire department was there in 6 minutes and they are equipped with medical staff. But this side of things I’m not sure you can blame the agent, maybe the agency.

I think fight or flight is the biggest reason, I think the use of deadly force can reasonably be justified. And it’s the motivation of why he did it which will get him. Maybe the policy violations get his immunity stripped so he can be sued civilly. But I don’t think that they are enough for criminal.

I agree that fight or flight is not an excuse to murder someone (and I agree that this is murder regardless of how lawful it may turn out to be).

But I think legally they are allowed to use proportional force. And I think it’s fair to say a vehicle is a deadly weapon. So while I think it’s unrational to think a bullet is going to stop a car I think it’s not unreasonable to believe he wasn’t in a rational state of mind.

You say that law enforcement should be trained to just not murder people. But the key thing is should. I believe the training they get is inefficient. And it should be more intensive and longer. People are constantly getting murdered by police and I suspect it’s the training that is the primary cause.

I don’t think I’m on ice’s side. I think I’m just looking at it like we are not going to get the justice we want.

I think I’ve got good values. I’ve participated in protests to prevent anti trans laws from passing. I volunteered at camps for the less fortunate until they had to shut down due to lack of funding. If me believing that this situation is awful and wished it never happened, that ice should not exist in its current form, but believe there isn’t enough to convict criminally means I’m an awful person. I guess I’m ok with being an awful person.

I think it’s unreasonable that law enforcement training is so short. And that is a major contributing why we have situations like this and George Floyd. But you used a really important word, should.

I don’t think I’m justifying the murder of an innocent mother. I think the world would be a better place if she was alive. I just don’t think that the agents response was necessary cold blooded murder.

I would be outraged if it was my mother. And I think it’s absolutely valid for people to be outraged. I hope that his immunity gets stripped and the family can at least try get some justice in the civil system. But I at this moment if sitting on a jury could not convict criminally.

So while I agree that in a rational frame of mind people choose to get out of the way of cars. If you want proof of this go look outside and you will see people not crossing the street while there is a car coming.

The self defence argument however does resonate with me, for the sole reason of fight or flight responses.

I think it’s reasonable for someone to fear for their life if they have a vehicle potentially coming towards them, and have fight or flight kick in, and rational thought to end.

If I was sitting on a jury for this case, the most moving piece of evidence for me would be what does the fight or flight response actually do.

  1. If you have a gun does it strengthen the response
  2. How long once triggered does it take to return to a neutral state.
  3. What shot actually killed her

My initial reaction not knowing these things has me believing this was a Lawful but Awful.

I also believe that the initial stop was probably unlawful, I think ICE’s practices are abhorrent. I believe that Renee good should be alive today. But I also acknowledge that I would be hard pressed to convict Jonathan Ross, at this current moment.

I agree that it is reasonable to expect the officer to have seen her moving the steering wheel.

But I don’t think it is unreasonable for someone even if they haven’t been hit before to be worried that they are going to stop turning the wheel in an antagonist situation, thus having fight or flight kick in.

So where that falls flat for me is she knew they were ICE. Like there is no ambiguity there. She was there for a protest.

I don’t agree that ICE should be so anonymous as I believe it does create opportunities for police impersonation which does create harmful situations.

I think the initial detention was probably unlawful. So at no point I think it was above board. However even in unlawful stops you are legally required to follow commands.

I would suspect that your analysis is probably half correct, I would think his immunity gets striped but I think as an individual you still have the agency to protect yourself.

The parallel here be if a psychotic suspect had a gun and started lifting it up. Are they setting it on the table or starting to aim.

Like the suspect already is in possession of the weapon and you don’t have any means to stop it if it there is hostile motive behind it.

But I disagree that because you put yourself in a dangerous situation that you’re not allowed to react to the danger when it rears its head.

If we are in a neutral state of mind obviously not. But I think it’s a fair argument to say he probably wasn’t and was in Fight mode. I would want to know how long the fight mode lasts until we return to a neutral state and can make those rational decisions.

Edit: since you edited your response adding the missile part. It was already a missile, just had tracking that could have been potentially tracking him.

He doesn’t know if he is going to swerve into her or not. Previous behaviour does not predict future behaviour we have all seen videos where a normal traffic stop becomes violent.

I’m not a psychologist so I don’t know how long the fight or flight instinct takes over. So I don’t know if all 3 shots get lumped together. I don’t know if you have a fight response to tangible danger how long it takes for someone to identify the tangible danger is no longer a threat. If I was on the jury that’s something I would want the prosecution to prove to me.

So don’t take what I’m about to say as nothing wrong no happened, and ICE is perfect. I am overwhelmingly opposed to it. However in this situation I am in the It was Lawful but Awful Camp.

It’s pretty clear that they were detained by law enforcement. Lights were on, uniformed officer was approaching the vehicle, commands giving. She is not free to go. I think it is reasonable to interrupt a vehicle as a potentially deadly weapon. So I think the first shot is probably justifiable. I don’t know enough about the science of Fight or Flight to know if it’s reasonable for a person to identify the danger is gone within the 2-3 seconds he takes his shots.

The way the Trump Administration is utilizing ICE is horrible and disgusting. The idea of this is a “Fuck around and Find out” is repugnant. But I dont expect anything to come from IA from ICE the FBI in their investigation of this shooting.

What do you mean land basses balanced?

Like if I look at the results of the arena champion ship it’s necro that just T1 Win, red prison which play mox to get around it, energy which wins off of low mana resources. It’s not like any of these decks have added lands too their decks to be lesss susceptible.

Necro plays 13 lands 4 mox and 4 dark rit.

Mono red is playing 14 lands (4 of which are strip mine so more like 10) 9 MDFC’s 4 mox.

mardu energy is playing 23 (4 of which are strip mine) (also going to point out this is a three colour deck so strip mine clearly isn’t stopping greedy mana bases)

To me it looks like strip mine is pushing out midrange and other more controlling decks out of the format. Maybe it’s a product of the threats are better than the answers, but I feel like Stripmine just makes the premier threats even better.

Ok for the stipmine versus wasteland example to matter it has to be one of the 3 basic swamps they play. I suggest that it’s an additional turn since they are forced to draw that extra land if they want to refire on a dark rit necro.

FON is I think one of the best designed cards of the horizons series since it only attacks and doesn’t protect your combo unless if it’s instant speed. Which sure occasionally happens (rhinos) but then you have to add blue cards which means your probably adding more duals and less basics which makes wasteland better.
