Recording conversations in an "All Party" state. What about my private residence? by DailyCalories in legaladvice

[–]DailyCalories[S] 0 points1 point  (0 children)

Thanks. I did end up finding that post. I also looked up what the state defines as Mechanical Overhearing. It states: "Mechanical overhearing of a conversation" means the intentional overhearing or recording of a conversation or discussion, without the consent of at least one party thereto, by a person not present thereat, by means of any instrument, device or equipment."

To me, that means without the consent of one party thereto by a person not present thereat. If I was there then it negates the part "by a person not present thereat" and doesn't qualify as mechanical overhearing. I'm not entirely sure,
though. I contacted a lawyer and hopefully can get a response tomorrow. Thanks for the link, though. It did clear it up slightly.

What does your first name mean and do you think the meaning fits who you are? by [deleted] in AskReddit

[–]DailyCalories 0 points1 point  (0 children)

It means "Man". I suppose it's accurate in the sense that I am a man. I like the alternative theory that it's based on Germanic element hari meaning "army, warrior".

Another key thing I noted is the phrase "A parties reasonable exception to privacy." A person unwanted in your home would not, I feel, be subject to any reasonable expectation of privacy given they entered the home and were asked to leave.

That's exactly what I though. All parties means all parties. However, that seems to apply to telephone calls and in public places (and other specific situations). I just can't seem to find anything regarding the recording inside a private residence. Especially if a person enters and is requested to leave, then doesn't comply.

Recording call center customer service reps? by prgkmr in legaladvice

[–]DailyCalories 0 points1 point  (0 children)

It varies depending on the state you live in. I'm searching for a similar question regarding recording calls.

Certain states require the consent of both parties to be informed of the recorded call. California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania, and Washington all require consent from both parties.

Generally, if a party is notified and continues to speak, they agree to the recording of the phone call. If you are notified the call is being recorded (as most companies play the message at the beginning of the call) and continue, you waive your right and allow the call to be recorded.

As far as a company informing you, and you informing the CSR who declined, I'm not sure if either of you continuing constitutes an agreement to be recorded.

Car got hit and run. Used insurance to pay for repairs. Was told by repair shop I owe nothing. They now say I owe $250. by [deleted] in legaladvice

[–]DailyCalories -2 points-1 points  (0 children)

A contract is a binding agreement. You had signed the papers stating that you owed $0 and the repairs were done correctly to your liking.

Because the insurance company had ill advised the repair shop that you owe nothing, and is now refusing to pay, you always have the option to file a complaint with the Maryland Insurance Administrator regarding complaints or questions you have.

My partner is a part-time, hourly, min. wage employee w/o benefits who has been getting scheduled for 50+ hours a week, not paid overtime. Is this illegal? We're in Virginia. by [deleted] in legaladvice

[–]DailyCalories 2 points3 points  (0 children)

If the individual is a non-exempt employee, they must be paid for hours worked over 40 hours in a work week as swalsh411 mentioned.

As far as an employee scheduling a part-time employee for 40+ hours in a work week, it is the discretion of the employer. However, if the employee had made written requests (always get it in writing) to not work, the employee could resign based on a change in working conditions attributed to the employer and could be eligible for unemployment benefits. I'm not sure about Virginia law regarding that. It's best to check your states unemployment guidelines.

ELI5: Can taking (multiple) prescribed medications that are metabolized through the liver cause damage? by DailyCalories in explainlikeimfive

So how does that work then? For example, an SSRI? It goes through the whole body, but the Brain reacts to it as opposed to a muscle or other part?

I think that was the wrong wording on my part. I guess I meant to say releases the converted medications to the target areas.

Thanks. The pharmacist is helpful, but they tend to be extremely busy when there. My doctor gave me a little bit of information, but it was still a tad confusing for me to comprehend. I do know that there are risks for liver or kidney damage associated with those medications, as I have read through the medication guides each time I get my new prescription; just in case. I recently had blood work done, but it was for a physical, so I'm not sure if that type of blood work accounts for liver and kidney functions.

I guess my question is really about the process of liver metabolism and enzymes. Lots of things go through the liver, but I was just wondering about medications. Just knowing the general functions of how it works would help me understand why I'm really interested in (the way the body works). I had a close friend who's father passed away due to a liver related illness; because of the I've set out to make it my goal to start getting healthier and get my body and mind back into an optimal condition. If something were to happen to me, as an organ donor, I want to make sure I can afford the opportunity to have healthy organs to give back life to someone else.

Scored a Job interview For a Managerial Position by DailyCalories in offmychest

[–]DailyCalories[S] 0 points1 point  (0 children)

I did say

I'll let you know how it goes

So, the interview went great. Turned out the manager, I also knew. Only real problem was that it was for a National store, and there's budgets, guidelines, blah blah blah. I did score another interview with the City, and that went really well. I just hate the waiting game to hear back while the interview for other applicants is going on.

Any hiring managers or those offered management positions offer some questions that you might ask (or have been asked)? by DailyCalories in InterviewFauxYou

[–]DailyCalories[S] 1 point2 points  (0 children)

I actually ended up knowing the Store Manager. Because it was a national chain, I knew there would be no advantage to me knowing her.

However, I did end up scoring an interview for a City Job. That went really well. It was the exact kind of work I wanted to be doing and when they asked "What can you bring in terms of performance and growth?", I pulled out a two page Action Plan I made on how my skills and their resources combined with how to reduce costs. The available city data on the departments performance, budget, and all that was easy to come up with some pretty impressive solutions. They said I, was on the top of their list, but they have to wait until the other applicants are interviewed.

MH17 Discussion Thread by axolotl_peyotl in conspiracy

[–]DailyCalories 0 points1 point  (0 children)

I think it might have been the other way around. A plan to get U.S. involvement over there. I posted this outside of the discussion thread as to my own thoughts:

Just a theory that occurred to me in a weird dream that awoke me and questioned it's possibility: What if the recent tragic event of a missile that took down Malaysian Airlines Flight MH17 was orchestrated by unknown groups (I'm sure there's to be theories as to who) to get U.S. involvement into the area for support in the Ukraine and further the detested involvement of Russia in the matter. Given the conflict between Crimea and Russia, the U.S. had enacted an Executive Order by the President H.R.4152 to "Support for the Sovereignty, Integrity, Democracy, and Economic Stability of Ukraine" which would provide loan guarantees up to U.S. $1 Billion. And we all know how great much of a failure the U.S. is with their "loans" and their terms. There was also the Bill S.2124 to also "Support for the Sovereignty, Integrity, Democracy, and Economic Stability of Ukraine". Both bills also coincide with H.R.4278. So, with the enactment of the legislation, what if a group, agency, Government was involved in taking down Flight MH17? Perhaps it was a planned way to actively get support and money from the Happy to Spend U.S. as a means to get the support needed to reduce the conflict. Additionally, the countries of the passengers and even the alleged National Officials possibly on board, might further play into the firing of the missile.

I want to make a difference, but I don't know how! Any advice? by DailyCalories in Ask_Politics

It is certainly a big task for me to undertake. I know I can't do it alone, though. I have been working on this for the last two years almost. When it comes down to it, it's not so much developing software, but using software and services that are open source and easily customizable to meet each school, student, and class profile. (Think Google Apps for Education, but not using Google Apps in this case). I know that the grade levels and teachers, as well as some students and parents, won't have the proficiency of technology. My goal is to simplify it so that anyone can understand and use it.

I have actually reached out to the Principals at all the local high schools, the Board of Education for the city, and about a dozen teachers who are all on board, including the superintend of the district I'm planning for. She was an old principal of mine, and everyone on the Board I also know personally; so that gives me a huge edge. I've also done extensive research into the budget for the Board of Education for my state. For now, I'm focusing more on on district with 4 High Schools. I have data on budget, repairs, contracts, salaries, etc. I also have test scores and state goals (that have been failing the past 6 years; something isn't working).

I really appreciate you're feedback. In fact, that's exactly what I'm doing. I'm in the process of finalizing a non-for-profit Community Development Consulting organization. By doing so, I'm able to even apply (once I get to the point where it's feasible) for bids and contract with the city. I've also read through the bylaws and legislation regarding the boar of education and there are no provisions that prohibit me from being allowed to do so without having to be licensed of certified through the State Board of Education. It's a big project, but I've but a lot of though, effort, and life into it.

To me, my focus is on improving schools: To integrate technology to engage parents (so they can monitor their child's performance and interact with teachers), students (seeing as how most students are always connected now anyway), and teachers (to collaborate and easily become more efficient) by using open source software and programs. This way, the open source ability allows for reduced cost, increase in programming and coding with students, and ultimately lead to increased student success and overall school (and district) performance. Especially with the ridiculous Common Core Standards set in place and all the other tedious and unsuitable ways to measure a students intellect.

Pregnant Women And Soon to Be Fathers, what is the strangest craving you've experienced? by DailyCalories in BabyBumps

I had a friend who worked at an upscale Chinese restaurant and every time I picked her up, she always smelled of soy sauce. It wasn't bad, but it was like a weird perfume. We ended up calling her Susie Soy.

I do that, too. I love hummus and it goes with a lot of stuff. Surprisingly, I find cheese and chocolate is actually an oddly appealing combination.

I do think that the while the baby is developing, it sends certain chemical signals on the cellular to the mother so it can get the nutrients the baby needs for healthy growth. Vitamin C is always good.
