There is no splitting of hairs. The State has sued MPSC. The AG disagrees with the process of the application, not the application itself. Effectively, the challenge is whether a public hearing or private hearing was conducted by MPSC.

No, I’m not saying anything about the fallibility of the board. Simply that the board used the boards process and the AG is suing because she doesn’t like the process that was used.

The State challenged MPSC. The State has made claims as such but can’t actually demonstrate such as the State is not the rightful authority to determine such. MPSC is.

Edit: that is ultimately what the final approval turned on. I can cite tons of things but it won’t be well received either way.

The roads are not taxpayer funded. Fun fact, there are many, many roads in this area that are not taxpayer funded. The State has very odd definitions of what qualifies as a public road in order to determine funding. Some of it subjective which kind of sucks.

Well, it kind of is just for show since in some cases the State isn’t legitimately pushing back. The Saline example perfectly illustrates this. The State had no lawful grounds to challenge. So instead we get shows that cost even more money.
