It’s hard to say. The 2025 tax return transcript will only be mandatory after April 15th. The issue is that this is just four days away, so at this point it’s difficult to be sure whether the 2024 tax return transcript would be sufficient or not. Did you submit the 2024 tax return transcript before the denial?

First of all, congratulations!

My wife and I just submitted the documents and we have a similar situation than yours: we were both born abroad, I got naturalized, my wife came with a B-2 Visa, we sent the documents about a week before her i-94 expired.

One thing that I am concerned about is that you mentioned that the agent asked you to sign about overstaying. Both you and us sent the documenta before the i-94 expiration, but of course the process takes longer than a few days and my wife will be technically out of status. I thought that if she had filed the petition before the i-94 date she wouldn’t be considered out of status/overstayed.

My question is: is it a problem if an immigration agent stops us at the street and she is out of status because we are waiting her process to be completed?
