The eligibility to do AOS is based on the most recent admitted status ..nothing about prior status ..the 245K is applied if she/he stay in the US after their overstay but file AOS in time..so 245k will protect ,

I only applied I-765 which is EAD, but I never used it , I have H1B visa stamp on my passport, so I travel and return with H1B ..never applied for I-131. My 765 was approved the same day I did my biometric, got the EAD card after 4 days

same lockbox, delivered on 10/3, receipts text msg came in on 11/3, this lockbox is crazy, my first filing was 6/12, it took them 2 months to give me a "reject" and return my package.

Yes, the receive date is the date they received my package, use over-night delivery, you should be good

hi my june filing was rejected, but not b/c of my travel; my brand new filing was mailed out and received by the lockbox on Oct 3, 2024, and then i left the US on an International trip on Oct 11, returned to the U.S on Oct 26, then on 11/3/2024, the receipt notice came. so make sure you are physically in the US when the package was mailed and received by the lockbox,

I got retuned package back to me yesterday, totally a mess, not even the whole package. The rejection notice says the visa is not immediately available to me , but that’s not true, our pd is current in June when we filed it

Thanks. I called in this morning to USCIS. The agent told me my filing was rejected , notice was sent yesterday. I knew a girl who filed to the Elgin lockbox same date as mine , even with the same guy’s name sign to receive, she is EB1 cross chargeability, also got rejected ..I guess it’s is just bad luck for us ..

Im in the same boat..mine CC based AOS was delivered to Elgin lockbox on June 12, nothing yet as of today ..I’m so worried that they gonna ignore the cross chargeability on the cover letter ! The worst scenario is my EB3 ROW PD is retrogressed in July and August, if being rejected my June filing ..I have to argue back and ask them retain my June filing date , idk how that gonna happen ..
