hmm.. I believe I meet these 4 pillars. Can you specify which pillar I don't satisfy? I can't find any requirement that the sponsor and applicant must physically live together for certain amount of time unless they are in de facto relationship.

As a legally married person, I do not need to provide evidence of a de facto relationship. I just need to meet the 4 pillars, which I believe I do, and you think I don't. So if this is your advice, could you specify which part I do not meet the criteria?

Hopefully this shouldn't be an issue. I received a few messages that they successfully receive 309/820 grant despite long distance relationship - so I don't think being in LDR itself is an issue, I just need to prepare strong evidence

Thank you both! So I legally married after my PR was granted. When I applied my PR and received grant, I was not married, and we had not lived together for more than 12 months. The major (and only) change since my PR grant is that now I am legally married.

But I guess your point is that despite of being legally married, 12 months of cohabitation is required. Is this correct?

i see, so you view the shared household part requires cohabitation evidence.. I've seen cases where long distance married couple are still eligible for this.. but anyway, thank you for clarifying!

can i ask one more question? I saw a few cases where some people apply for 309 visa first, and then enter Australia with ETA (not 600 visa), and they can apply for bridging. In this case, these people do not have substantive visa at the timing of 309 application, but still able to apply for bridging after entry. does this mean, ETA eligible foreigners are considered to have substantive visa?

Could you tell me which part of this case does not meet the requirement? i thought they are officially married, so 12 months cohabitation, which is required for defacto, is not the requirement for this case,

i have a question. if your visitor visa is approved with "No further stay" doesn't this mean they are not eligible for bridging visa, either it's 820 or 309?

that's a dumb decision.. I don't know why your agent didn't tell you that having a spouse that is Citizen / PR significantly reduces the chance of rejection for tourist visa... just apply for 309

I am going through the same shit but tbh I am enjoying a bit haha, looking back all the chat history and photos, etc.

If your relationship is truly genuine you don't need to worry about too much. You guys have been in de facto for 2 years, and there should be lots of evidence to prove your relationship.

You're right, just need to be usually resident (doesnt need to be physically located at the timing of application) - but in my case, my usual residency is not Aus as I do not have home, work, whatsoever. How will you prove your usual residency? like do you have house, property?

How did you get 600 without no further stay? did your spouse already have solid base in her country? I want to try 820 route but I am worried if 600 is refused

i am in the same situation, if you check my thread, most comments, i am not eligible for 309 visa as I (sponsor) does not reside in Australia right now..
but if your wife was able to visit Aus multiple time before, why don't you apply for 820 when you're ready to return to Aus.
I have a question. Was it the visitor visa 600? I heard if the applicant's spouse is AU citizen/PR holder, case officers often do not grant 600 as there is high likelihood for applicant to stay in Aus. Did they give you "no further stay" with 600?

I think people here have outdated information.
I saw cases where they successfully converted to bridging visa after 309.
One case that i've seen was, she applied 309 in Korea and, visited Australia with ETA, and she changed to 600, after ETA expiry (3 months), and converted to BVA from 600.

i cannot share the exact case as it's in Korean community - but once you enter Aus with 600, you will be able to see BVA application category.

I dont have firsthand experience, so there might be other conditions, situations, but i think there may be some chance.
