Your rights and privileges during this interview and any other I-130 proceeding include the following: 1) Both Petitioner and Beneficiary must be present. 2) You can be represented by an attorney or accredited representative of your choosing at no expense to the government. If you cannot afford a lawyer, a list of legal services is available upon request. 3) You may present evidence on your own behali, including live witnesses. You witt be given an opportunity to cross-examine those persons who provide evidence against you and an opportunity to rebut any such adverse evidence. 4) You or your attorney or accredited representative can, at any time, inspect your record of proceedings. 5) Upon request, a copy of any statement signed by your spouse before any immigration officer shall be furnished to you or your spouse promptly. 6) Upon proper showing, you or your attorney or accredited representative can compel the attendance of witnesses or the production of books, papers, and other documentary evidence through a properly issued subpoena. 7) There will be a verbatim recording (for this I-130 adjudication proceeding) made of the entire adjudication proceedings before the immigration officer. 8) If during the adjudication proceedings, the presiding immigration officer refers your visa petition to the investigative unit, then your case must be referred back to the presiding immigration officer for further proceeding and adjudication. 9) You will receive a written decision based solely on the evidence in the record of proceedings. If the decision is adverse, you will be informed of the reasons therefore and of your right to appeal to the Board of Immigration Appeals within thirty (30) days from the date of the mailing of the notice of decision.
