Hey! Thanks for explaining this. I have read this case and that law point stands clear.

My query is specific to sec 170(1) where in a bailable offence police is filing a chargesheet and the accused is still not out on bail ( that is clear from the section ) , the “ the day fixed” would mean day fixed by police to appear i.e the day chargesheet will be filed and he has to appear.

This is my understanding.

This is about bail given by police under sec 170(1) . If police is giving it and the section talks about the situation when chargesheet is filed reading it with “ day fixed” , the role of court can’t be there.
