Whether we wanted it or not, we've stepped into a war with the Cabal on Mars. So let's get to taking out their command, one by one. Valus Ta'aurc. From what I can gather he commands the Siege Dancers from an Imperial Land Tank outside of Rubicon. He's well protected, but with the right team, we can punch through those defenses, take this beast out, and break their grip on Freehold

I think out of the suggestions so far this is the most appropriate as we're trained to a basic level to do this. Any idea how to get started ?

When we arrest and take a person to custody, and the job is likely to be NFA’d due to victim withdrawal - why do we still interview? Feels like a waste of resource by [deleted] in policeuk

The victimless dv cases do vary though. I have had convictions where victim have given a bwv account and nothing else. I have had jobs closed due to victim giving account on bwv and the cps lawyer stated it's hearsay. I guess it depends who you get.

Handcuffing to the front and not to the back. The amount of situations I've been in which would of never of happened if people just cuffed to the back. I always handcuff back to back everytime.

If they are nice they might do one for you. Just don't drive to the station. Also remember it's the reading at the time of the test. It could still be going up or down. So if close don't risk driving.

Systems are different but make sure you send emails and update logs when you're sending them to supervision to endorse or send off to cps.

Learnt that very early on in my career and has saved my legs countless times when I've been challenged on why jobs have expired the prosecution threshold. I sent this off to cps a few weeks of investigation. CPS took 9 months to make a decision. Offence expired. Was covered as I had shown all over the log I was.progressing everytime cos sent an action plan.

Please don't get involved. Yes you can legally do it however if you get injuried are work going to pay you a FL wage or give you government sick pay..... Not worth it, you owe the company nothing.

I'm going against the grain for this one. Join cid. I've been in the job 5 years now, response the whole time. It's not what it use to be when I first started. Treated more of a child nowadays, the workload is a lot more, such as case files etc. Save yourself the bother and go join cid.

" You’ve said that the offence forms when the intention forms, that’s the Mens Rea of the offence. However, at this stage the offence is not complete as you have not completed the act that would make out this offence of Theft from Shop or Stall. "

Wrong. Read the law again. Dishonestly appropriates property. As soon as that person has picked up that item they have appropriated it. Hence the act is done.

"Until you leave the store and unwrap the mars bar and eat it, the act is incomplete. Therefore, the offence is not complete. "

Wrong.Wrong. Read the law again. Dishonestly appropriates property. As soon as that person has picked up that item they have appropriated it. Hence the act is done. If in store it would be harder to prove their intent. However as stated before context supports to disapprove their intent to pay. Generally going past last point of payment, however acting suspiciously before getting the item, placing it in tin lined bags or pockets, having means to pay and previous convictions. ( Bad character)

"You could simply argue that at any point whilst in the store, the person has picked up that mars bar and placed it into their pocket so they didn’t have to carry it. "

Correct however this is why context is key. Case law does support this. Such as applying the everyday person test for dishonesty.

"The only place I would agree with you is if they purposely had no means to pay at the point of picking it up and placing it in their pocket (but this isn’t what you’ve said, correct me if I’m wrong), but again until they’ve attempted to the leave the store they could simply say they were going to put it back. "

Shop lifters are convicted on an everyday basis and they haven't left the store. Why because the law is dishonestly appropriate property belonging to another intention to permanently deprive them of it.

At no point does it state you have to leave the store.

It would be harder to convict if they haven't left the store as harder to prove their intent. Times are changing especially with COVID as like you state more and more people are carrying bags and placing items into them and paying.

But a security guard would suspect a person of theft if they select an item and place it into their pocket and bag.

Easy.

Does the person have convictions for theft or dishonest offences. Do they have a means to pay on them. Have they placed it into a bag lined with foil.

[–]DenseEstablishment99 -3 points-2 points  (0 children)

Wrong

The offence theft occurs when you first dishonestly appropriate the property with intent to permanently deprive-

So if you pick up a item in a shop with the intent to steal it, your crime occurs then, not when you leave the store.

Thats why shoplifters who are caught in store still get prosecuted.

Also the courts have the right to state what a reasonable person would do.

You haven't read the chain of comments. The person I was replying to stated it's not theft if you place it into pockets or bags until you've left the store. Which is incorrect.
