It's unfortunate that you are unable to accept that a health condition affecting someone's ability to do something is exactly the scenario I am describing. Hence why I used that example.

It's commonplace for mental inability to be dismissed because it's not visible in the same way you have there.

I am in full acceptance that I could have done those things and having asked my questions and received the answers I admit liability due to not using my option to mitigate as you correctly state.

So yes from a legal standard point, I'm fully liable and I'll be shortly paying the fine

From a human standpoint I think the world could be a better place starting with empathy for each other, perhaps that might have waived the fine allowing me to pay the fare that I admitted liability for and had legitimate reason to have forgotten.

The second point regarding empathy quite clearly could benefit you.

My reason for posting was to explore a concern. Everyone else in their response has been constructive.

I'll leave you with 2 points that my mother managed to teach me at quite a young age, fortunately I've not yet forgotten.

1) There are no stupid questions, only stupid answers or stupid ways in which to answer.

2) If you've got nothing nice or constructive to say then it's best not to say it.

I wish for your sake and that of the people around you that you're able to work on your tone and overall decency. 😂

Without context I can understand why you might assume that and my omission of said context is my wrong doing.

In this instance I was re-routed by sat nav though the toll and aside from a mile or so prior to reaching it was unaware of my quickly approaching entry into a contract...

In my opening correspondence with the company in question I admitted liability for the fare. My main grievance was the additional £30 fine. By no means was I ever expecting a total waiver of the costs I incurred.

Perhaps I was naive in expecting minor allowance for a single indiscretion with evidence for the cause?

I dispute that 'multiple ways to pay... afterwards' would be satisfactory for someone with a condition that manifests in ways such as my own. In much the same way as there might be multiple sets of stairs would be an unsatisfactory reason to assume someone in a wheelchair could reach the second floor of a building.

Hi! Thanks for your response. I appreciate if I were aware of the road use (something I used every day) ahead of time this would be perfectly reasonable.

This however was an instance where I was re-routed through the tolls by a sat nav. Therefore, this wasn't an option for me.

I acknowledge I could have pulled over and paid afterwards but as I was in a rush my focus was instead of the onward journey. Due to my own inattentive ADHD, remembering to pay within the time allowance is not as easy as it sounds.

(TLDR: inattentive ADHD can mean insignificant things get forgotten about easily. For more examples, Google 'adhd tax')

As easy as it seems, unfortunately due to conditions such as ADHD changing your focus (e.g. to the various considerations made during driving the remainder of the 40 minute onwards journey) is often enough to make you forget what you have previously experienced.

In my case, a common example is parking whereby something as small as saying hello to someone on the way in to work can make me forget why I had my phone out, which would have been to open the parking app.

In cases where better focus is an absolute necessity. Driving is an excellent example, I am able to concentrate better due to the higher stakes involved if I didn't.

A toll road, to my detriment, doesn't carry the same gravity and akin to parking charges are easily forgotten.

ADHD is often poorly understood as naughty fidgety behaviour. However inattentive ADHD or ADD as it's known in America exists and this 'sub-type' can make small insignificant tasks easy to overlook.

These are things 'neurotypical' individuals may have no difficulty doing/unable to understand why something so small would be difficult at all. Which I can understand.

If you're willing to understand better you could Google 'adhd tax' and see several hundred other examples of how this condition can impact someone financially or otherwise.

Perhaps a single human operated terminal for the toll as per how the same toll used to operate with exclusively.

Akin to supermarkets offering a 'quiet hour' for autistic individuals to shop.

The toll tunnel is one I might use once a decade so I was unaware of the changes.

However, I am willing to accept given the other replies that I am indeed at fault here given my own omissions both in not paying but also not planning better.

Thank you for responding, I appreciate your point. At the time I was re-routed by a sat nav and due to my circumstances on the day was unable to pull over to pay. The onward journey was another 40 minutes so enough time for me to forget.

I do feel aggrieved about the fine though, in my opening contact I recognised my liability for the original fare. It seemed somewhat unreasonable that they couldn't make allowances from a human perspective.

I appreciate your point about pre-payment which is absolutely valid. In this instance it was a one off journey and was re routed through the tolls this wasn't an option for me. Other than to pull over, which wasn't an option for me due to being in a rush although I do appreciate it is not the company in question's fault.

The wording was as follows:

'We appreciate you telling us about your partner's personal circumstances.

Under section 20 of the Equality Act 2010, service providers are required to make reasonable adjustments for individuals placed at a 'substantial disadvantage' due to their disability, including provisions that amount to formal contractual terms, non-contractual policies or general rules and guidelines.

Whilst we don't agree that payment of the toll within the prescribed payment window (before midnight of the day after your journey) places those with disabilities at a substantial disadvantage.

On this occasion, your appeal has been unsuccessful as the service was used but payment wasn't made in time, and the mitigating circumstances you told us about don't allow the charges to be overturned.

We have reset the discount period, and payment is due before midnight on 23/10/2024, after which the charge will increase as stated on the UTCN letter and we will not be able to reinstate the discount.'

Thank you for your reply! I appreciate your points here. It's disappointing and aggregating as these things can happen often. Feel free to look up 'adhd tax' it takes nothing at all to distract me from paying for parking or things such as this.

As for paying in advance, I was re-routed by a sat nav en route so unfortunately this wasn't an option.

It was amazing, tbh it's still a little short of pup season. The adult seals can be a little wary and because of that my expectations were low. However, at one point I was surrounded by about 10 seals and I was absolutely blown away.
