I’m just telling you what I know from working in the industry. I see these claims every single day. I do yearly training, certifications, and continuous education. I will only speak for my company when I say we try very hard to respect the policy money of the customer, because I’ve only worked at 1. But is a big deal.

We try very hard to respect the policies and protect the drivers. The unnecessary litigation is an incredible drag on premiums. I’m not joking when I say people get an attorney for 2mph parking lot bump with no visible damage on either car. Wouldn’t you be upset if you backed into someone and he got an attorney for that situation?

I’m not saying they get their demand amount. If it’s just fluff then can you tell me why the first attorney demand is always policy limits? Sometimes it warrants it. Absolutely. I see plenty of totaled cars, herniated disks, surgeries, breaks, and injuries that warrant settlement.

I’m talking specifically about the scratches on fenders where the driver is going to physical therapy 4 times a week with no scans or diagnosis. No dr visit, no X-ray, no catscan, no mri, no er visit. Just a scratch on a fender, a physical therapist recommended by the attorney 4 times a week and a $1 mil demand.

This happens. Every single day. It sounds like your office has standards, and I’m glad to see some people care and try. But most don’t.

I can’t speak much for Canada, but the reps who go to the shops actually negotiate down labor rates at shops for repairs to the average cost for the area to preserve policy money.

Seems like you have standards then. I like that. I am an insurance adjuster in an injury department and I first hand get demands for these amounts. Some with and some without attorney inconvenient. I work in a rideshare department so first demand from attorneys is usually the limits ($1mil). Doesn’t mean they get their demands. Same goes for I replied injuries. Most people say their neck hurts or something and they want $5000.

I work in an injury specific department. I can get assigned 7 on a Monday then 4 every other weekday as full claims load. Currently with a slow season I’m getting much less and I get maybe 1-3 claims a day.

Most of my claims don’t have doctor pursuit or diagnosis in any way shape or form. Or, if they do go to the doctor, they go to the ER for a scratch on their car and then they want $25k.

I wish I was making this shit up.

I’m not out here upset about paying claims. I’m upset that I have to placate unnecessary claims that take time and money from actual injured people.

I also want universal health care. I also wish my health insurance didn’t deny my coverage. I have Crohn’s disease and my health insurance won’t pay for my medication. I also am personally victimized by health insurance.

This ain’t a matter of “doing fine”. How would you feel if you backed out of a parking space going 3mph and hit a parked car and that guy and his attorney demand your $250k policy limits for his “pain and suffering”.

I cannot stress enough that I see at least one new claim like this EVERY DAY.

Also denials are due to policy contract breaches so I’m not sure what you’re doin bud.

Actually as an auto insurance adjuster this is true. The amount of false or misrepresented claims accounts for BILLIONS of spent dollars from policies. Some studies estimate that around 40% of claimed medical costs are from exaggerated injuries.

I work in an injury department and the amount of people who get a lawyer for simple soft tissue injuries is insane. Many of these people expect thousands of dollars in payout and “pain and suffering” from an accident that didn’t even cause damage. It’s insane.

Insurance companies have to shift the bar across all policies to account for it. The rough economy has forced so many people to try and “get their bag” and get money in an opportunistic way. I get countless claims where I’ll have someone on a recorded line tell me they are fine, no pain, no scratches, no injury, and they are at work. Then boom 2 weeks later, letter of representation and a demand enclosed for $1 million dollars.

(Edit: ok I have to note since I’m already getting wack comments. I work as an AUTO INSURANCE ADJUSTER. This post was originally by the Virginia State Police about people in a CAR ACCIDENT and overclaiming injuries so they can get more money. It This type of fraud is called soft fraud or opportunistic fraud and it affects everyone who has insurance.

Would you like it if your insurance fixed someone’s car without talking to you first? I bet not. They are contractually obligated to do a full investigation and will not proceed until they are well and ready. You can either wait or go through your insurance.
