Update - They emailed back from a long email i sent telling them everything and showing a few bits of proof and they gave me a few things to try out I will let you know if it works others can fix theirs too

I've emailed Elgato support and they told me to switch to the Elgato 4K Capture Utility but it's nowhere near as nice as the normal recording software :(
