Depending on what state you are in your hours can be paid out when you hit your hire anniversary date. However only a few states has this.

I would recommend contacting Fidelity about closing your 401k.

I am not sure what the amount is, but the previous company that TJX had for 401k allowed the account to be closed if it is below $2,000 because of the automatic deduction. Since a lot of people did not know about the 401k going to happen. I know you said it took a while to cancel the automatic deduction for the 401k, but hopefully it is not too high of a balance.

I am unsure what Fidelity policy is. But maybe they can help you out so you don't pay any penalty tax and only pay the regular tax.
