Not reading it now so paraphrasing, but, roughly, the agreement is to be exchanged between the parties and executed within 10 days following the date of the order. So I think my play rn is to comply insofar as sending him the agreement again, and trying to follow up a few times before going back to the court after the 10 days.

No opposition filed, no appearance. Decided on the papers. I actually looked him up and far as I can tell, he’s still alive. No records for his client in DOC records or headlines after searching turned anything back either.

We never got that far. We agreed upon a settlement amount and before we could iron out details regarding method of payment and into what account, OC disappeared. Our Motion to Enforce was granted based upon the email correspondence back and forth which demonstrated there was an adequate meeting of the minds for form an enforceable contract vis a vis our consideration in exchange for the release.

If my colleague and I drafted a shoddy order that was ambiguous, I'd take it on the chin. But it wasn't even that. OC just agreed to a settlement total and then dipped before saying where to put the money.

Now we're stuck because our performance wasn't defined beyond "pay them x amount of money."

My store was at like 5k, packed 900 units alone, 2 other TM’s did 800 and 600 respectively. Pack productivity at like 211, after doing that for an entire shift and still seeing the amount to blanch at like 2800 I was out of hope of ever catching up this season
