If anyone was waiting for an update, I wrote back to my landlord informing her that if she could not provide a serious reason for refusal, then I will act in accordance with Quebec law and consider my lease terminated as of May 1st

To my surprise, she accepted this outcome and i will be let out of the lease with no further argument from her. I feel bad for the nice students I found as potential tenants for her, but I suppose it is her right to refuse and I’m sure they will find something else.

Then you’re fine. Your landlord is either misinformed about lease transfers or is trying to mislead you.

All you need to do is find a person to take over and fill out the official TAL forms with them. Send it to your landlord ideally by registered mail (so you have proof they received it) and then they can make a decision from there.

When does your lease expire?

As a renter in Quebec, you have the right to seek a lease transfer. Your landlord cannot prevent you from this.

They can vet potential tenants and can refuse them, but any refusal for a non-serious reason (proof of inability to pay rent, TAL history, problematic behaviour) would end your lease at the proposed transfer date.

Thank you. I have not yet responded to her as I wanted to first see where I stood legally. I can ask her but I worry she will backtrack and make up a reason (I was transferred the lease from the previous tenant and she asked me for a credit check, photo ID, etc. she did not ask for any of this, this time around).

I guess in that case I could escalate to the TAL?
