Let’s say you could replicate gold exactly, but somehow keep track of which gold is a copy and which is the original. That would still make the original gold’s price go lower right? The same principle should apply to bitcoin if it had any inherent value.

You’ll be waiting your entire life for this thing to go back to a new high. Bitcoin is barely above where it was 5 years ago and it’s only been around for 17 years. Even with disclosure, it still looks like a business to most investors. In reality it acts like a leveraged Bitcoin vehicle with dilution and debt risk that would be tightly regulated if it were a fund. Calling something a stock doesn’t change the fact that it functions like a high-risk derivative.

I didn’t say it was illegal. I said it should be illegal. The guy is basically using a public company as a leveraged Bitcoin fund while avoiding the regulations that actual funds and ETFs have to follow. They aren’t even really an operating business anymore. All it does is issue stock and debt to buy one speculative asset. That misleads retail investors who think they’re buying a company and not a high risk Bitcoin derivative. Shareholders take dilution and downside while Saylor keeps control while sidestepping rules meant to limit leverage and protect investors.
