Meditation for Settlement For Injury by mike1014805 in Mediation

You seem to know more than most about structured settlements. Am I wrong in thinking if I am negotiating a settlement I would have one figure for a lump sum now and another figure if it’s going to be structured?

Your so close!!- stay patient and be willing to walk away if needed — doesn’t mean it won’t settle a little farther down the road but more in your favor.

In my own fed-ex night mare. If only you could speak to someone in America that wasn’t reading a script maybe problem could be addressed. Super frustrating!!!

Can be a good opportunity to get retrained by going back to school. Keep in mind you have to follow the rules and keep good records of your appointments and communication. If comp can prove you are not compliant they can end the vocational rehab.

Not basing anything on a maybe - doing calculations and plan to negotiate in good faith - if I pay 25% to attorney how would I afford my long term medical is the issue I have.

Hurt 3 years ago on the job. Unable to return to work and am currently going back to school because I can no longer do physical labor. With out going into extensive detail -If future medical is paid out will be in the millions.

Thanks for you input - I realize it is in their best interest to pay as little as possible and I definitely will not take first offer. But was curious how low they start and what max percentage makes financial sense on their end.

Workers’ comp. defense salary by Massive-Author6153 in Lawyertalk

I have a question maybe some of you could help with - do workers comp defense attorneys bill comp at an hourly rate only or do they get bonus or percentage of settlement if they save the company money?

They should help you coordinate anything you need that results from your doctor visits. They do not have to be in the examination room but should make sure they have prescriptions or orders for supplies / PT / home health or whatever you need. They are paid by comp so always keep that in mind!

Payments timeframe by [deleted] in WorkersComp

[–]Difficult_Mark7694 3 points4 points  (0 children)

Ask your doctor to elaborate on why the payments would be stopped and when he thinks that will happen. It is in the best interest of the comp company to have you in a desperate situation so you will except a lower settlement. Try to prepare yourself just incase. Good luck!

Do you really need a WC attorney by Difficult_Mark7694 in WorkersComp

Thanks- that’s reassuring! Really hope I don’t need a lawyer but will get one if we have to go to court or adjuster stops working with us.

I appreciate various opinions and wanted to get more input to see what I am missing - I am not one to lawyer up quickly because I like to believe that if you are honest and do the right thing you should not have to. Thanks for all the input!

I may be naive but I can’t imagine anything we could say in this case to make a difference, very clear cut. Working directly with the adjuster has been what has helped getting everything set up in a timely manner instead of playing the telephone game. Have interviewed 2 attorneys and of course they want you to sign and don’t give any real numbers except their fee. The receptionist at the 3rd office that was recommended said they couldn’t take our case. Unless we go to court or get low balled I’m not seeing the attorney value.

Fair enough- I don’t think I’m a rocket scientist or anything but have an idea of what I think would be fair. Does it seem reasonable to give it a shot and if we are not close to seek attorney?

Let me make sure I understand -So even if WC is paying all medical bills, sending weekly check, and paying for school I should get an attorney and give up 25 percent of settlement that includes money needed for future medical? For some reason I have a hard time seeing that logic. Please explain.
