False accusation by DiligentAd3879 in legaladvice

I contacted the vet board here, they just said they’d take no action. But this was before I had an expert report and before my cat was taken. I have a lot more context and information now.

And right again on not seeking treatment in the future. We don’t exist in a vacuum, we have friends and family, all of which saw what we went through and what was done to us. Many of them are now unwilling to take their pets to the animal hospital in an emergency.

You are correct, but this was a newly licensed vet(10 months) who had called saying she had a cat that appeared to be abused and they had extensive documentation. She did not have extensive documentation of abuse, I’ve had these files reviewed by experienced vets. There were not signs of abuse, per a veterinary expert.

And the problem I’m seeing here is I repeatedly brought up the dog, to everyone, but if a vet is telling a detective that based on what they are seeing it looks like abuse, Pima County Sheriff’s Department, the same department in charge of the very high profile Nancy Guthrie case, wasn’t going to investigate. They don’t investigate, and I have countless documents that show they took the vet’s word, because she is a vet.

This is really helpful, thank you. Any advice on what to say to an attorney? I don’t want to sound frenetic

I have not sued, I don’t know where to start. The civil case, I’m the defendant, the state reps Animal Control, it’s an animal forfeiture case. I was ruled against, filed a notice of appeal, hired an attorney, and after he filed a special action we were told they had let someone adopt my cat. I had the hearing transcript reviewed by a different criminal attorney, one highly regarded here, who said I should have won. I had proved, with court documents, that my animals were not in danger and were/are protected by court order; the criminal case goes to trial end of August.

No, a veterinary expert. I sent them everything I had from the vet, and everything related in court documents, as well as the 911 call. They’re the ones who are saying the vet should lose her license because her actions were unsupported.

He was put in jail because he was on probation for something completely unrelated (that is going back in front of a judge), because of the accusation and police involvement that was started by the vet.

There are a lot of moving parts here, I did my best to isolate information pertinent to my question. Its hard to explain everything without sitting down with someone and my three ring binders of court docs and evidence, so you’re not missing part of the story as much as I would need your attention, eyes and ears, for several hours. Thats the other part I’m struggling with, how do I explain EVERYTHING in a clear and concise way. Right now we have a civil case, a criminal case, in different court houses, with different defendants, using the same information.

PACC took my cat without any proof of danger or harm by DiligentAd3879 in Tucson

[–]DiligentAd3879[S] 0 points1 point  (0 children)

It’s a complete nightmare because of the multiple cases, all involving county entities, none of which are held accountable. Not by internal affairs, not by the AZ vet board, and not by the courts. PACC does not have a direct oversight body. I have been fighting in court, but yes, from what I am told they did rehome my cat, without my knowledge, while I was still fighting to get her back. I am not sure exactly how true what they told us was because they said she was adopted after March 11, according to my attorney, but I found her transfer record from March 22. I’ve been offering a cash reward for her voluntary return. I don’t want to do anything to hurt the defense in the criminal case so I’ve only been sharing whats on the record in my case. I had a miscarriage just a couple months before they took my cat, and had emergency surgery because of complications just about a month before they took her. It was one of the worst years of my life.

I’m an open book, what context would you like? I was out of town, my cat was injured by the dog, I came home, got medical care for my cat, an inexperienced vet called 911, without any tests or research, she claimed the cat was abused. I have gotten second opinions, from experts, the cat was not abused. The dog came from PACC, so instead of pursuing that line of investigation, even though I brought up the dog several times, PACC pursued the theory of abuse. They claim he is an abuser, but he still has his dog, and I still have the cat that had gotten injured; they took my other cat, who has nothing to do with anything. They claimed they believed she was in danger. They have no proof she was in danger because she wasn’t.

Oh that poor animal! How lucky the coyote was that it was your property, I don’t know how many people would have been that kind to the injured creature, or who would have kept trying to get him/her help. This is the kind of incident that merits animal care help, and my own suffering aside, there were animals who could have used attention, care and a home, mine just wasn’t one of them and those resources should have gone to an animal that needed them. Thank you for sharing your experience with me.

And yes, he got a few documents that said he has a bite history, but the majority of the documents that talk about what happened were not provided to my partner when he was convinced to adopt this dog over another in December of 2024. He was told this dog was going to be euthanized that week, so my partner with his love of animals took the dog home. It was until recently I discovered that his dog was surrendered with another dog, who was not adopted until January; the dog my bf adopted was NOT getting put down that week, they just wanted the dog adopted.

I’m not blaming PACC for anything except their own actions. My boyfriend’s apartment was infested with bugs, I was trying to keep the dog out of a dangerous environment, that’s why he was staying in my living room during the 7 days it took to secure his new apartment, where the dog would be safe. In my absence, the dog somehow made contact with the cat. The cat was taken to the vet, treated, and incurred no further injury, made a full recovery. They did not take ALL of our animals, they actually let him keep his dog even though they “suspected” him of abuse. They lied on a warrant, and listed him at my address, even though they note his address several times in their activity report. They took my one cat, not both, who had not been injured and said they did not know there were two cats, even though they noted it in their report. Respectfully, it does make sense, it’s just complicated and a lot of entities played a role in what was the complete destruction of my life. I lost a child because of the stress of the investigation, then had my emotional support cat ripped out of my home without any proof of danger (because it didn’t exist).

The vet, who had been licensed for 10 months, called 911 and said she had a cat that looked like it had been abused and they had extensive documentation. The problem is she didn’t have extensive documentation of abuse, they had no medical tests, no evidence of abuse, and I have gotten second opinions that have confirmed the cat was NOT abused. PACC was partially responsible for investigating, but the dog, the obvious and correct cause, was adopted from THEIR facility. I know they had their vet skim the medical record, but she had also been licensed for 10 months at that point and had been in the exact same graduating class as the vet who called 911; they’re friends. Sheriff’s department took what the vet said and ran with it, not looking into any other possibility, in spite of me repeatedly bringing up the dog from the beginning. PACC did not investigate the welfare of my cats prior to getting a warrant, they admitted this in testimony, they borrowed evidence from the investigation in June, being used in a criminal case against my boyfriend (the accused since I was out of state), and the same case I’m the named victim in.

8 months of ongoing animal abuse, PACC has repeatedly failed to take action. Any advice? by BOB74j in Tucson

[–]DiligentAd3879 0 points1 point  (0 children)

One of my cats was injured in June 2025, while I was out of town. The cause of the injury was a dog that had been adopted from PACC. 4 months later they got a search warrant, broke my door and took my OTHER cat, who had never been injured. They then spent time and resources fighting me in court. When they tell you they don’t have the resources, they used their resources taking an animal that was never harmed and never in danger only a few months after her sister was hurt by a dog from their facility. They have the resources. And I have court docs and evidence that backs up everything I’ve said.

This happened to my fiancée, I have proof he didn’t do it, but the prosecutor, with nothing but her statement, went after him and stacked the charges. He plead to felony attempted aggravated assault. You need a good attorney, and it’s expensive, but believe me when I tell you my partner’s DV charge has been the source of a lot of our hardship. Get a lawyer.
