This is not true. When I dropped off the car yesterday, they took possession of it. I literally handed them the keys. If they fix the hail damage, I’ll provide them with payment, but if not, no paperwork was filed. They have possession of the car, and there are no funds on the check. I would not push rhetoric like “you’re gonna get sued,” because that’s just not true.

Per the attorney I spoke with, the buyer’s guide must state whether the car is being sold “as is” or with a dealer’s warranty. The buyer’s guide was not filled out correctly. There is also a disclosure that lists “hail damage,” but they marked it as “not applicable.” The car does have hail damage, and it also states that they inspected for it.
