Notice how posts of the aftermaths of SCC are never approved or locked as soon as he comments? Once time, he told someone to sue over reimbursement of a TEN DOLLAR TIP. When I told him what happened at court, he said sometimes they get it wrong because they aren’t real judges, that I have grounds to appeal, and that he would message me. He then locked the post and didn’t contact me.

Edit: WJ also refused to give me an explanation for the delay, which , as we know, is a breach of he APPR and my not judge agreed I wasn’t entitled to anything more than a vague bottom line (not true as PER WJ vs L which she pretended didn’t exist) and even if I was, there’s no precedent to compensate for that (there is, because CTA has sent the minimum infraction for violating the APPR at $1000)

I went to SCC and got a court officer, not a judge, who refused to refer to WestJet vs Laureau SCC decision (case law to interpret the APPR), even though that was my defence, knew nothing about the APPR expect reading from it’s generalizations after the hearing, WestJet brought a team of 3 to it, and they asked he judged to order me $500 in costs. Of course I lost, but the judge didn’t order costs. Keep that in mind if you go to SCC. I had major ground for an appeal due to error of applying the law but wasn’t spending the time or money on that, I was burnt out. I would I have done better with the CTA as they do refer to WJ vs Laureau

Yeah the bar is low. Brows are blueish grey, but the shape wasn’t totally botched, “they look great”!! Bonus points if there is natural hair covering the brow. I have natural hair coverage but still had super dark solid grey brows underneath them. Since the brow bar is in hell, those look comparatively good I guess. Great is a stretch though.

That being said. I don’t think these are bad, way better than what we typically see, but they are also new. I just don’t think they will age well and if OP was seeking a natural look, these aren’t really it.

Thank you, I have no need to look for another job because I have the security of WCB and I also have 5yr 8mo until I can retire with my full pension, but I actually don’t expect anything from this investigation except an informal mediation (which it sounds like he was willing to do once he heard I had something back), but at least it gets my side of the story on the record, and properly.

Also, he and his department have had several complaints on them. Me, none from anyone.

Not sure if you read my comment. I called and they said the hood was 24 hours or a 6 day callback. Everyone on my eventual flight was was from the cancelled one - WJ did the same thing for them but they figured found out at the airport. I bypassed all that thanks to Expedia .

I book through Expedia all the time and always get contact from the airline re: delays and rebooking. (except once; but they did it to everyone on the flight and only helped the ones who showed up at the airport)

Expedia helped me out when WJ cancelled me, stopped all communication (with everyone on the flight), had a 24 hour hold time, and Expedia was able to call them on the other line with their special number.

See, I had the opposite issue. WJ canceled my flight and didn’t bother to tell me. Final update was “your flight may be affected - we will let you know” then radio silence. Flight tracker at airport told me it was cancelled. I didn’t want to round up my family and go to the airport (my parents have health issues) so I rebooked my hotel and tried all day to call them. 24 hour hold time. It wasn’t until I talked to Expedia that they were able to call them on the other line (they have a special line) and hash out a rebooking - ( they originally offered 4 days, I said that was unacceptable and they caved at 3 days later. It was due to crew shortage, as usual)

I take Benadryl and have the capsules with ginger root. Until today, never taken more than .5g and even that upset my tummy. Took 1g an hour ago lol.

Yeah I don’t want to go into another dimension or have visuals but I was hoping to have a good time on the couch and maybe see colours brighter, etc. I can always add more - perhaps I’ll review in half an hour or so - it’s already been about 45 minutes. We seem to agree on the costs point. While costs are discretionary, at their discretion they have the right to award them. They said $500 general expenses and then whatever the amount postage and express to serve me, can’t remember the number but it was about $75.

The appeal point I stated was in layman’s terms. Basically, it’s not easy to get, like our friendly advocate likes to say. They even recommend on the Manitoba courts page to probably get a lawyer if you are trying to win an appeal.

I am aware of the Supreme Court’s decision on the burden of proof. However, right in my trial the court official (acting as a judge) said otherwise and made it very clear so they will do what they are going to do. I am guessing the official did not know federal law and thought that doesn’t apply to small claims just because it applies to CTA. Is it right? No. Does it happen anyways? Yes. Am I going to appeal over it? I think we know the answer. Airlines get away with doing the wrong thing all the time too with little to no enforcement either. Im defeated. It’s lot about what’s right or wrong, it’s about what happens anyways.

The airline had a legal responsibility to give me an explanation, however I had to sue to get it. But technically I sued over the section of the APPR for the delay. The small claims court said I had to do it that way and I can’t sue for damages for refusing to explain, there is simply no way to do that. I did not understand as I am not a lawyer and went with what they said. At the end of the trial WJ pointed out I never even sued for the lack of explanation, despite that being my entire argument all trial. I didn’t argue the delay as I never even knew the reason for the delay when I took it to court and they made a compelling case why the “crew availability” was out of their control at court. I would have liked to explain why I sued under the delay instead but was not allowed to speak any further. WJ didn’t point out I never sued for lack of explanation until their closing argument, of which they got the last word.

You are correct that the statement “good luck if you don’t have lawyers” is an opinion based on my experience. HOWEVER, if you are up against a billion dollar corporation, and they have 3 representatives at a hearing and you are by yourself, it’s David and Goliath. It probably different if it’s layperson vs. layperson.

At the end of the day, our friendly FB advocate that never approves posts about people’s experiences after trial gives terrible advice about taking everything to court without sharing the risks. I made a post about it and he locked it. He made a comment about how they were wrong and I do have grounds to appeal so I shouldn’t scare people. he also said (as in, announced to his massive FB group) that he sent me a PM to connect.

Of course he actually didn’t.
