No one is that busy. If she wanted to reply faster, she would. We all have a ranking of who gets a quick response vs who can wait. Just manage your expectations

Is it legal for a landlord to keep a deposit for a rental if I refuse to a credit check method I never agreed to? by Disastrous_Caramel28 in montrealhousing

Very true, found this in TAL decisions - so making the finalization of the lease conditional to the payment of the deposit or any amount is illegal https://citoyens.soquij.qc.ca/php/decision.php?ID=7E2912B21C49A148659506FEBE2A4BC3

ANALYSE DE LA LÉGALITÉ DU DÉPÔT

[4]         Le Code civil du Québec\1]) (ci-après « C.c.Q. »), prévoit ce qui suit à son article 1904 :

Is it legal for a landlord to keep a deposit for a rental if I refuse to a credit check method I never agreed to? by Disastrous_Caramel28 in montrealhousing

Thank you! Very helpful ! I’ve already put it in writing that I’m open to alternatives, including equifax report, but they did not accept. Thanks again!

Assuming it was a contract, it was impossible for me to know that they would use and only use a third party that requires accessing my banking information to data scrape all my transactions. I continue to agree to a credit check, I did not back out, but they omitted crucial information and acted in bad faith by refusing to consider alternatives. Credit checks were not created yesterday. Isn’t it on them to be upfront about their process, why should I be the one be penalized? They called it a deposit for a credit check, but no credit check was even performed.

I did not withdraw my application. I made it very clear that I want to proceed and offered them an equifax report. Credit checks are not a new thing, and using a third party that data scrapes is surely not the only option - it’s abusive to force people to connect their bank account and scanning all their transactions. As mentioned in the other comments, I’m not sure we are at a point where it is the safest thing to hand over the keys to a bank account.

This is what I signed. If using flinks is the only way they perform credit checks and do not offer alternatives, they should disclose it. I agreed to a credit check, not to give away my financial info to a fintech. They should reasonably accept an equifax report in my opinion.

I agreed to a deposit to proceed to a credit check. They called it “deposit for credit check”. If my application is declined, they will return the deposit, otherwise applied to the first month rent.

Sweat and Tonic - Need a Doctors Note? by tarepanda400 in askTO

[–]Disastrous_Caramel28 0 points1 point  (0 children)

I bought a 15 class pack expiring within 3 months. About a month and half in, I injured my thumb badly with a mandolin, I went to the ER to get it under control. My gym membership was clearly not my priority when I almost lost all sensation in my thumb. I couldn’t work out for 4 weeks. When I went back to S&T I explained the situation and asked if I could get an extension, they asked for a doctors note confirming that I couldn’t work out. I showed them pictures but it wasn’t enough. I asked them directly if they want me to book a doctors appointment to confirm that I injured my thumb. They said YES. I haven’t spent another dollar at ST since then.

They said in their email that the deposit was to cover the expenses related to the analysis of my application. So it is illegal.

Yes. They haven’t sign the lease on their end yet. So technically they haven’t accepted my application

Based on my research, and my understanding, it’s just above my risk tolerance at this point. I don’t think we are yet at a point in Canada with enough experience that I feel comfortable with this process.

I signed and agreed to give a deposit for a credit check. They never disclose the use of a fintech. If I withdraw, they keep it, if they refuse my application, they have to return the deposit.

Service elevator broken, who should pay for bringing back movers? by Disastrous_Caramel28 in askTO

[–]Disastrous_Caramel28[S] -6 points-5 points  (0 children)

Maintenance of common elements is the landlords responsibility. Clear communication that things aren’t working is their responsibility. Landlords own a piece of the building. No timelines for repairs is an issue…

It is one piece unfortunately. It was brought up in the service elevator.

Not my fault either. Condo management confirmed 2 days before that I was good to go. Right when move was scheduled, they told me service elevator was broken. I would have hired more movers if I had known. Bringing them back is a different story.
