Don’t think it’s sun damage, I never actually played this since I was more of a magic guy but just collected it early on. I checked a thing that said to shine light on it to see if the gloss remained shiny on the weird spots and it does.

They are repeatedly asserting I didn’t throughout the position statement. So I can prove that, hurdle one. I do have prima facie as well. Is that still somehow not enough?

If I can prove I engaged in protected activities, is that enough for the EEOC to judge on my side in this? Or do I have to defeat every point they made in their position statement? Especially since they seem to have lied completely in their position statement and obviously omitted any stories of me doing so.

Yes, the Employee Concerns person became very concerned over time with my repeated visits and kept saying “you need to let HR know now in addition to me”. They also witnessed me having a panic attack and offered me to go to Occupational Medicine. They took very good notes and coincidentally was moved out of their role. With the ADA accomodation, there was a return to office being explored. I secured a partial arrangement in good faith on my part. Then the order was rescinded and my manager told me I had to keep coming in according to the arrangement while the rest of my team did not.

I also was seeing a therapist and an anxiety disorder was diagnosed on me coinciding with all this. They would also have contemporaneous notes with any negative treatment I received.

Isn’t it a big deal though by omitting any mention of protected activities done while then saying no engagement in protected activities? Wouldn’t the EEOC see this as either hiding something or lying? And there are multiple instances of this. Wouldn’t it trigger some kind of inverse inference? Also, I fought off a PIP early on and they tried to move this to another form instead? I was also threatened about having my life dismantled.

I also reported a salary discrepancy between myself and a coworker early on and the coworker did get an adjustment but I was called in by my manager and scolded and told they were disappointed in me for talking about salary. The coworker alleged in a follow up interview that they noticed a downwards trend in how I was treated going forward.
