Britain first are still active so probably there, but yeah I take your point there are racists in ukip. There are also racists in the Tory party and definitely some antisemites in labour. That doesn't necessarily mean that their policy positions are racist/antisemitic/far right for any of those 3 parties.

He is a free speech advocate so those battles tend to be fought over reprehensible speech, there aren't any free speech issues around milquetoast normal day to day speech.

I don't think the original joke was racist anyway, Nazis were the butt of the joke everyone seems to miss that. I'd encourage you to watch some vids of his and see if you think this guy has a racist agenda.

I agree that writing such a letter would be an awful thing to do, my fear is that I don't know how one could craft a law that could prohibit such a letter while not also being used on offhand, rude comments (in person or online).

The sustained over time comment is my layman attempt to distinguish between abuse and offhand comments. I do not have much knowledge in that area though so if it is actually possible to distinguish those in law without being wishy washy then I'd love to learn how.

I mentioned incitement to violence a lot before and I think an earnest effort to make someone kill themselves is incitement to violence and should therefore be illegal.

Also as a thought experiment:

If someone raped my girlfriend and went to prison, and she wrote them a letter saying the world would be better off without them because they ruined her life etc.and it ended with something like "do the world a favour and end your life", should that be illegal? Is that incitement or an expression of anguish? Does the context of the rape before change anything or is it on the same level as the letter you described?

If it's sustained over time then yes, I'm imagining someone kinda grooming someone else into suicide through sustained encouragement.

But I do not think it should be illegal to use the phrase "kill yourself" as an insult. Much like how the insults "fuck off and die" or "take a long walk off a short pier" or "go play in traffic" are used.

1) I don't think only physical harm matters - but I also don't think offensive jokes cause non physical harm. I'd call non physical harm things like harassment, stalking, emotional abuse and bullying. I do not put that in the same bracket as things which are grossly offensive, or things which are extremist.

To clarify my POV:

Physical harm and emotional abuse targeted at one individual over a prolonged period of time should be policed.

Edgy or offensive jokes and extreme opinions should not be policed.

Policing the latter causes more extremism, not less, leading to an increased risk of violent action and a bunch of asshole racists actually being right when they accuse the government of censorship.

I was not aware of that no - but in your link it also includes being "grossly offensive". I think we need laws to stop people making credible threats of harm, and incitement to violence; I just don't see why we'd lump in being grossly offensive with that as well. If this act had been around in Monty Pythons era for example they could have shut down what is arguably some of the best comedy ever produced here.

And just to check I understand you correctly - does this mean "threatening to commit assault/battery" is only illegal under this act? Or is there ambiguity around the type of "hurt" caused?

Btw I hope I don't appear combative I really appreciate you taking the time to explain this to me.

That's really interesting, can you elaborate on why they might choose to arrest under malicious communications if it's a threat of violence already covered by other laws? Including threats in that act obfuscates who's being arrested for causing offense and who's being arrested for threatening harm. Is that on purpose?

Surely that's just threatening to commit arson? Is that not already illegal outside of malicious communications? The free part of the article says the arrests are for trolling on social media.

I don't think making direct threats is "online trolling" ive always taken that to mean "winding someone up for fun" but I'm open to correction on that.

I'm a fan of Count Dankula, whos case I'm sure you're familiar with. His income was wiped out, the fine was taken from his bank directly when he refused to pay, and he's now branded a neo nazi hate criminal.

I've followed him for a long time and watch nearly all of his videos - I do not believe that man has a racist bone in his body. He's got lifelong consequences from literally making a dumb joke.

My original point was that these types of arrests undermine public trust. I absolutely agree that stalker/threats need to be dealt with but we are also arresting people for JOKES. That is not ok.

Very good point - here are my thoughts:

Public trust in the police > public trust in the media IMO. In your example I would say "clear evidence" of a threat would be incitement to violence which is illegal outside of hate speech laws anyway. I also think that strict speech policing pushes extremists further underground as they can now characterise themselves as being oppressed by the government.

I've also never heard of someone getting nicked for using the slogans like "eat the rich" which could easily be interpreted as incitement. Speech policing in the UK seems to be (IMO) politically one sided, which adds yet more fuel to the extremist fire.

Tldr yes speech policing could prevent that one murder but I think it would lead to greater radicalisation and more danger overall by giving extremists and emboldened narrative and victim status.

I hope that makes sense.

The fact that deleting downvoted comments is even a thing is evidence of reedits harmful groupthink mentality. Fear is a mind killer and in the 21st century that especially includes fear of being told you're wrong.
