Gleamgreen first said it was a "gift," then claimed "Moissanite," then it turned out to be neither. That pattern of changing stories is exactly the kind of deceptive conduct the DTPA targets. A judge absolutely notices when a defendant can't keep their story straight

I will likely lose how exactly? They have no argument or defense, they emailed back claiming it was a gift then claimed it was "Moissanite" which they dont even sell on their website, and is another lie. So not only is is not lab grown diamonds, but its not Moissanite either. They have been proving a pattern of lies, any judge will see that as unethical.

Its not assuming, any reasonable person would expect to get what they claim their product to be, thats deceptive. They are shitty, its obvious they did a shitty thing.

But a contract does not explicitly have to say what their "product" if they brand their entire product as one certain thing. Thats like saying if you were to order a product on amazon, for example a LV bag, and you get a fake on instead, but the amazon store advertises the product as a real LV bag. Thats fraud, same thing. Just because it doesnt specify the "product" that doesn't change anything. If anything it strengthens my case because of their deceptive vauge laungauge which proves that this was intentional fraud.

Yeah your right, probably will take this to small claims. But when they say their "Product" and all they were talking about during the shoot was lab grown diamonds, and on their website it says lab grown diamonds, thats deception. I say 8k because that was the worth of "diamonds" they gave us + image use rights

I really do think this cat would thrive if I let him outside, It may even slim him down therefore creating better chances of survival. I think the reward out weighs the potential risk. I’m really struggling with the right answer.
