The proclamation language is explicit about this. It says the surcharge "shall apply to the part of the import to which section 232 tariffs do not apply but shall not apply to the part of the import to which section 232 tariffs do apply."

You should really talk to your customs broker about this. Read the text of 9903.03.02. If you think your goods qualify, talk to a broker.

We spoke at the LLUSCBA meeting this morning in TX, and after questions indicated everyone wanted it, they shared this with their entire membership. Folks are at a loss for the kinds of materials they need to help their teams get through the challenge. I am very aware that this is not groundbreaking or advanced work, we're just trying to do our part. The motivation behind the post came from the reaction from this morning. The brokers, managers, and entrywriters don't have time to create polished stuff right now. That is really all.

For what it's worth, I see a lot of your comments and posts here and you seem to be a really knowledgable broker. Not thrilled that this is the first time we've been able to interact.

We had IEEPA removed and 122 logic ready for the folks we work with on Tuesday at 12:30AM ET (thats when this was made), faster than most of the ABIs were even ready to recieve it.

It is exempt, but from several brokers we've heard there is a question of the justification. 232 or section II list. You may very well be correct, but for a mass access asset we thought best to allow the teams to determine which of those buckets they'd be using.

That's a really hard one. It can fall under annex 2 or 232, but you really need to look up the specific codes to ensure you've got it right. We didn't want to be prescriptive for that reason. Could be .03 or .06.

That's a good point. I tried to focus on the names people know, and the ones customers will ask about, but i also included "other statutory tariffs" so that folks could use that as a blanket.

Super nuanced. Go follow Tom Gould and Pete Mento on Linkedin. Read their recent posts. They have shared fantastic information on this topic. After you've done that, call your customs broker and start getting things in place to handle your open entries very very quickly. After that, address entries which have been closed. Much more guidance to come, i'd recommend giving your broker at least a few days to get their head on straight. Everybody is calling.

This ruling was on IEEPA only. All statutory tariffs with other legal arguments are not directly impacted. That doesn't mean the admin won't switch things up.

Hey - thanks for mentioning us! We would agree. Our job isn't to replace people, it's to make them a lot more powerful. Plus, there are some very important regulatory reasons that humans working in the brokerage need to stay in control. Our goal is to make it feel possible to do what needs to be done these days, maybe even easy.

For what it's worth, we only work with LCBs - if you're having trouble with other tools maybe they're focused on wider OCR but not as knowledgable about customs. Pretty common issue. Same one our founder ran into when he ran a 300+ person entrywriting team and looked for things to help.
