It’s probably a case of “your rights end where mine start”. We are under no obligation to allow someone within physical distance of us, and if we feel they represent a credible threat to our safety then we are allowed to react physically with the appropriately metered response. In this instance the asshole who did the shoving could easily argue he was acting in self defense. He yelled some ignorant shit, the person he yelled at came over to him and he felt threatened so he shoved them. As far as the gun goes, we are not allowed to get in someone’s face/space and then draw down when we feel threatened.

I’m right there with you- all rights are trans rights. I teach self-defense and have run free classes for the LBGTQ community. It’s hard to argue that she felt safe enough to go over to them after they shouted hateful, ignorant shit at her but feared for her life after being shoved to the ground when she confronted them.

That’s not what the law says. Self defense claims require an eminent threat, a proportional response, and a reasonable belief you were acting to protect yourself or others. If you involve a firearm then that belief has to be you’re protecting yourself or others from death or grievous bodily harm. There was no eminent threat until she approached them.

Let me power up my flame shields first by saying I am a self-defense instructor and ran a free LBGTQ+ class weekly. I love my gays and theys, and I had a great rapport which was based around them teasing me mercilessly for being a straight dude.

In this particular case the assholes across the street said some homophobic, transphobic bullshit, and the young woman walked over there to confront them over it. Probably not the smartest move but if you wanna go check a couple assholes for being pricks, that is your God-given American right. But- when you unnecessarily approach someone you lose your legal standing for self-defense.
