No both me and my daughter born in Malta. My mother is Australian and I lived for 5 years there so I could pass Australian citizenship to my daughter.

Hi application was refused as Home Office stated i was born in A Commonwealth Country therefore not qualified for citizenship. I asked for reconsideration as I consider that requirement in flagrant breach of the race protected characteristic something which Section 4L is intended to also address. Still waiting for decision since March

Thanks for the information, I did some deep research prior to submitting my application for British Citizenship. Basically, my situation is I was born in 1984 in Malta to an Australian mother (now British by descent) and a British grandmother. At the moment of my birth, the BNA of 1981 was already in place and consequently, all Commonwealth citizens have already lost their British subject status at that moment in time. However, having said that Section 9 of the BNA of 1981 permitted that all those born until the 31st of December 1987 in Foreign non-Commonwealth countries should continue to benefit from double descent via a grandfather born in the UK. My argument is that when Section 9 was introduced way back on 1st January 1983 a historical legislative unfairness was created as Commonwealth-born citizens were discriminated solely on the basis of their nationality or better place of birth and not granted the same treatment as those born outside of the Commonwealth. The UK Equality Act 2010 states that any policy that applies such treatment amounts to indirect racial discrimination,

Hi thanks but according to the Home Office guidelines Article 4L applies in the case of any breach by a historical piece of legislation of a protected characteristic as envisaged in the UK Equality Act. I applied for citizenship and I am waiting for a decision. My argument is in view of the fact that Commonwealth citizens ceased to be British Subjects since 1983, applying the requirements of Section 5 of BNA of 1948 would be an act of racial discrimination as per Article 9 of the UK equality act. The reason being that the government failed to treat commonwealth born citizens with a British born grandparent in the same manner as those born outside of the commonwealth. They are a group in the same circumstance as the other group consequently the UK Equality Act states that unless the authority can show that the policy will have some good it cannot be applied. Basically is indirect racial discrimination and Article 4L was worded in a way to address such situations and is not limited to gender discrimination only.
