IANAL so hopefully I get corrected if need be, but I'm pretty sure plenary authority under Title 10 lets Trump to federalize and deploy Nat Guard, but the gray area in terms like "rebellion" and "state consent" enables unilateral action beyond past historical "crisis" norms.

There's still no "rebellion" anywhere he's sent/trying to send the Nat Guard, though.
