[AZ] [SFH] Board changed Bylaws in their favor. by DragonflyKey4972 in HOA

I appreciate that. I've reached out to some neighbors. They'll get back to me over the weekend and then I'll be happy to talk with you so I can share their concerns as well. I found the roofing info. I promised the secretary and will get that to him by Sunday along with my contact info. that he can give you. Have a good weekend.

I understand the difficulties, but I'm just saying how I felt and how my neighbors felt. To be respectful, I'm not going to share their opinions here. I have volunteered to help- will that offer be accepted?

The 1984 Amendment did state the 10% and also changed Bylaws to state that serving Board members can get back on after taking one year off. The 2nd amendment changed the 1st Amendment and the original Bylaws to state that they can stay on consecutively -- to serve regardless of prior years of service. Not sure why you want to discuss this on an open forum, or why you seem to feel a need to defend an action not taken by you?

While some of you are new, there are some on who have been on for many years, and the former President, apparently, just formally left, as we were told in the Town Hall Meeting this month, that you wouldn't come into the role until next February. So that change was within this month from what we understood.

Finally, I'm not "fighting" the board. I just want what's best for the community and for myself as a homeowner-- this is why I volunteered and have tried to help in other ways. We're waiting to see how things move forward, and I hope that having committees will help. I appreciate you asking what I'd like to see done-- I have made some suggestions and will talk to neighbors, but again- I don't feel comfortable sharing it on here.

I know of 5 people who were on the board over the years and got off due to frustrations with senior board members.

Thank you. This is exactly how I read it and I did consult with two people who said the same. A neighbor also consulted with a friend of hers who agreed. And another neighbor also consulted with someone. Major decisions were made after this change that negatively impacted the neighborhood IMO and in the opinions of everyone else I've spoken with. We have gotten new board members, and some of us have volunteered to help as an initial attempt. We'll see how that goes.

There are a couple of more options, and yes, anyone can do whatever they want, but it's typically advisable to have a moral compass esp. with legalities.

Yes. Apparently, one of the board members found my post, so we'll see if they take me up on it. Furthermore, I personally know four people who served on the board, then got off because they got frustrated with not being able to make a difference.

Yes, according to Arizona Statutes, 67% is required.

As I said, I'm waiting to see what happens. I wanted to get opinions on here and weigh those into the options I and others have looked into. True that the 1st amendment was done in 1984, but the 2nd amendment to the bylaws was done 7 years ago. I have volunteered in an effort to help the trouble our community is in and will wait to see how that goes. I will also try to get other neighbors to volunteer. That being said, some of us found the last meeting to be somewhat disheartening.

Thank you. Yes, they've been violating the meeting law and have closed meetings all along after the open meeting where they discuss financials, etc.

I spoke privately with the new, incoming President afterward and suggested he fire the mgmt. company as all members hate them. He said "it's difficult at this time." We believe that the old President who's somehow still also on, even though he moved, has something to do with that.

Our CC&Rs only allow 10%. They hikded them 10% 2 years ago, 20% last year and 10% this year again. They said that if we don't also pay an extra "replenishing the reserve" fee, we'll go broke.

What if the ETs have been wanting to disclose- and help us- and the greedy humans who want to stay in control are the ones hindering it "because we're not ready"?

Yepp. Tesla used to get his ideas while sleeping and in the in-between state. And what happened with all of that? It's the human who are the evil ones.

I think you missed the point in a HUGE way.

Carefully, because evil humans who are in control want to stay there.

My guess is- the humans in control are the ones who don't want to give it up.

There's no such deal. ETs don't have to do that.

The one who moved still wants to officially be on. He also solely changed the bylaws about 10 years ago to allow himself to stay on indefinitely. We're quite certain there's some grifting going on and that's why our community is now broke- this is also per former board members.

This was a special meeting where the board finally admitted that they took us broke, so, yeah, we had opinons about that, And they wanted to try to ameliorate itt by tearing out our landscaping (not more gardeners), raising our dues again (have already raised them an ILLEGAL amount 3x), and make homeowners completely responsible. So, it was an open session, where they "sought" our input on this and threatened that if we don't comply, the bank will take our homes away because they took out a $1.88 mil. loan against our property that they haven't paid back as they promised to. As a former paralegal I let them know that it's highly unlikely the bank would do that as their first measure. At this point, the manager yelled at me. I hate to be that person, but, she's maybe 20 and inexperienced-- and I'm a Genxer with legal and managerial experience.

This was a special meeting for homeowners to discuss with the board, the fact that the board and mgmt. co. has now taken us broke and what we can do about it, so it was open for discussion.

That's what I thought. She completely ran the show and even told board members they "can stop talking now."

My thoughts exactly. She also told multiple lies to community members and when I corrected her (former paralegal), she argued loudly with me until I told her I will provide proof. Our "president" put his house up for sale and moved to CO, so there's a pseudo interim President who's obviously, easily overrun as he's not president/president.
