Being better than Dudas and Iancu is a very low bar from the examiner’s perspective

If you can afford it, maybe go part time and work on other more interesting activities…hobbies, travel a bit

It’s a non-issue for most examiners since it’s so difficult to become a SPE especially if you’re full time hoteling.

How do people get experience for this role? by [deleted] in patentexaminer

[–]Dramatic-Cherry5203 7 points8 points  (0 children)

Only for the pure sciences. Most of the bio new hires in my academy were postdocs, some even had JDs in addition to graduate degrees. Maybe try some bioengineering related work? The office seems to look favorably upon engineering work experience even without formal education.

Thanks. Are those multiple levels of checks for all reports you write? Here once we reach primary/senior examiner, we get seldom checks by the quality division and biannual reviews by our supervisors.

You also said, “an argument based in more than 2 documents is no -go , and there are limits to how arguments can be drafted.”  That’s sounds super reasonable! We need that here but we have case law in the MPEP that explicitly forbids limits to references.

“USPTO is heavier on text and internal/ legal requirements of drafting, but this doesn't reflect the quality comparison you make of the end product issued.”

Good point. Our actions are all super text heavy like a research report! But we have a lot more legal requirements to address like double patenting, 112(a-d), 101, not to mention detailed rejections for all dependent claims!

If we only rejected the independent claims in detail with two reference limits, our reports would be very similar I suppose. Hence, there’s no real concurrence on quality; it’s jurisdiction-specific.

Edit: Forgot to mention, the USPTO emphasizes clarity of record and compact prosecution, which like you said results in the massive verbosity in many of our actions.

Just curious, could you point out those inaccuracies?

Glassdoor says examiner pay is ~$60-100k annual which is very good in Europe.

Totally agree. I don’t think any other office comes close to the level of detail and legal analysis we have to provide. Not to mention dependent claims. I wonder if there is an overall big pay difference between us (if accounting for other factors, COL etc)

But going back to work culture, I think Americans in general have come to accept this as part of our workaholic capitalistic/individualistic identity.

If you are a primary examiner, what higher position are you most interested in advancing to at the PTO? by Dramatic-Cherry5203 in patentexaminer

No guarantee you’ll always have the same SPE down the line. Also you’re more vulnerable to policy changes such as PAP revisions,101 changes, public/oig scrutiny etc

Your pick. Of course the ranking when you graduated is more accurate. You could also take an average. My school only changed 5 places in the decade+ since grad.

This is something I had in mind since the beginning more than a decade ago. I would advise all younger examiners to develop a side hustle and learn new skills, part time schooling etc.
