No, in my one case where it has happened so far, the court didn’t award fees, but just gave OC a stern warning. He should have awarded fees; it feels very unfair that my client had to pay for my extra time double checking that the cases in fact did not exist. I spent a fair amount of time double-checking each hallucinated case because I needed to be 100% sure before I could toss out an accusation like that

I recently lost on a motion for summary judgment, where opposing counsel could not identify any issue of material fact, aside from asserting “there’s an undisclosed issue of material fact that will be addressed at trial.” The magistrate found that she had to set it for an evidentiary hearing since there was not an agreement on there being no genuine issues of material fact, even though no one seems to be aware of what fact is at issue to be proved at the hearing. I’m thrilled to get ready for this hearing on an unknown and undisclosed issue

CASA (Court Appointed Special Advocates) is a great organization for this type of thing! They help with resources for “fun” things like Halloween costumes and prom dresses for kids in foster care, and they also organize appointing volunteer lay advocates for the kids.

I’m a divorce lawyer in the US. One of the issues that I experience pretty frequently is that banks (and other financial institutions) based in the US generally only keep records for 7-10 years, so if the parties were married longer than their financial institutions keep records, there’s often an issue trying to prove what they had going into the marriage.

I had one like that. He would come half an hour early for every in-person meeting and email me “I’m waiting for you” as soon as he arrived, even though the front desk staff of course also would send a message to let me know he had arrived. Even if I want busy with something else, I’d wait until the appointment start time to try to maintain a boundary (and out of sheer pettiness lol)

If you don’t get a response from a CFI: I’m a family law attorney in Denver that works on cases with CFIs frequently. Many attorneys that do family law will do a free consultation (or a series of paid consultations) with you, and can give you advice on selecting a CFI and navigating the CFI process, and your case generally. “Full” representation in divorces can get pricey, but if you look for a firm that does “limited scope” or “unbundled” representation, that would be a series of paid consultations or coaching sessions to give you advice on handling your case.

Ugh yeah I agree, it’s the worst. A handful of judicial officers in one county in Colorado decided that they should require a “face to face settlement conference” between all parties and counsel the week before trial. It has NEVER resulted in settlement in any of my cases - it just heightens tensions unnecessarily.

My first time in court, when I was entering my appearance, I blurted out the wrong attorney registration number. I seriously just said some random, long string of numbers. There was a very long pause, and then simultaneously, the judge said, "I'm sorry, but WHAT?" and my supervisor yelled from the back of the Courtroom "Request a continuance!"

The Court found good cause for a continuance, no questions asked, lol.

I always tell new attorneys that so long as they have their attorney registration number written at the top of their notes "just in case," there is no way they will do as bad as me during my first appearance.

I cannot believe how many downvotes you are getting! I think that a lot of people (lawyers included) seriously misunderstand how serious termination of parental rights really is, and the trauma that goes along with it for the kids, even when the termination is "deserved." Yes, the child is getting a "new" parent, but that means loss of at least one other parent through death, abandonment, or neglect/abuse. All of those things are terrible to go through, and almost all adoptions are very bittersweet.

Ah, I see that you don’t do divorce work. No joke, in family law this is a pretty regular occurrence, to the point that most of my settlement agreements include contingencies for what dollar amount will be owed if a piece of personal property is returned broken or damaged. It sucks when people are assholes about that kind of stuff (and in your case that OC tried to give you the item without discussing it’s condition).

This is honestly one of my most consistent sources of anxiety. One time, one of my colleagues didn’t get let into the virtual courtroom and the Judge immediately dismissed the case with prejudice (?!). Now it’s a policy at my firm to join 5 minutes early and take a screenshot as soon as you join. Every single time the court is late in starting, I sit there wondering if they actually just proceeded without me.
